{"data":{"id":"us-ky/krs-393a.630","jurisdiction":"us-ky","citation":"KRS 393A.630","heading":"Administrator's contract with another to conduct examination.","body":"(1) As used in this section, \"related to the administrator\" means an individual who is:\n(a) The administrator's spouse, partner in a civil union, domestic partner, or\nreciprocal beneficiary;\n(b) The administrator's child, stepchild, grandchild, parent, steppar ent, sibling,\nstepsibling, half-sibling, aunt, uncle, niece, or nephew;\n(c) A spouse, partner in a civil union, domestic partner, or reciprocal beneficiary\nof an individual in paragraph (b) of this subsection; or\n(d) Any individual residing in the administrator's household.\n(2) The administrator may contract with a person to conduct an examination under KRS\n393A.550 to 393A.650.\n(3) If the person with whom the administrator contracts under subsection (2) of this\nsection is:\n(a) An individual, the individual shall not be related to the administrator; or\n(b) A business entity, the entity shall not be owned in whole or in part by the\nadministrator or an individual related to the administrator.\n(4) If the administrator contracts with a person under subsection (2) of this section:\n(a) The contract may provide for compensation of the person based on a fixed fee,\nhourly fee, or contingent fee;\n(b) A contingent fee arrangement shall not provide for a payment that exceeds ten\npercent (10%) of the amount or value of p roperty paid or delivered as a result\nof the examination; and\n(c) On request by a person subject to examination by a contractor, the\nadministrator shall deliver to the person a complete and unredacted copy of\nthe contract and any contract between the contractor and a person employed or\nengaged by the contractor to conduct the examination.\n(5) A contract under subsection (2) of this section shall be subject to KRS 61.870 to\n61.884.","path":["KRS Chapter 393A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48160","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:25Z","sha256":"b8c29b832a7dec11793f284d95e81772de199bc01de3a5f9168a7edf1b58a7e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-393a.620","next":"us-ky/krs-393a.640"},"notice":"GroundRules: Original legal text.
