{"data":{"id":"us-ky/krs-393a.690","jurisdiction":"us-ky","citation":"KRS 393A.690","heading":"Judicial remedy.","body":"(1) Not later than ninety (90) days after receiving notice of the administrator's\ndetermination under KRS 393A.650, the putative holder may:\n(a) File an action against the administrator in the appropriate court challenging\nthe administrator's determination of liability and seeking a declaration that the\ndetermination is unenforceable, in whole or in part; or\n(b) Pay the amount or deliver the property determined by the administrator to be\npaid or delivered to the administrator and, not later than six (6) months after\npayment or delivery, file an action against the administrator in the appropriate\ncourt for a refund of all or part of the amount paid or return of all or part of\nthe property delivered.\n(2) If a putative holder pays or delivers property the administr ator determined shall be\npaid or delivered to the administrator at any time after the putative holder files an\naction under subsection (1)(a) of this section, the court shall continue the action as\nif it had been filed originally as an action for a refund or return of property under\nsubsection (1)(b) of this section.","path":["KRS Chapter 393A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48166","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:25Z","sha256":"16fd545ab97fea275888bc9af9aaabdfe5e977af28628990c7bacf839633447e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-393a.680","next":"us-ky/krs-393a.700"},"notice":"GroundRules: Original legal text.
