{"data":{"id":"us-ky/krs-394.065","jurisdiction":"us-ky","citation":"KRS 394.065","heading":"Validity of trust, devise or legacy not affected by specified provisions.","body":"(1) No writing declaring and creating a trust, including a life insurance trust, when\notherwise valid, shall be an invalid trust or a testamentary disposition of property\nbecause the grantor of the trust reserves to himself: (a) the income of the trust est ate\nfor his life, or any other period, or the right to receive the income of the trust estate\nor have it used for his benefit for his life, or any other period, whether at the\ngrantor's direction or in the trustee's discretion; and/or (b) the right to rece ive\namounts of the trust principal or have such amounts used for his benefit whether at\nthe grantor's direction or in the discretion of the trustee; and/or (c) the right, at any\ntime during his lifetime, to modify, alter, amend or revoke the trust instrume nt, in\nwhole or in part; and/or (d) the right, at any time during his lifetime, to make\nrecommendations to or direct the trustee as to any or all investments of the trustee\nand any or all administrative or other functions of the trustee.\n(2) Subsection (1) above shall be applicable to all writings executed after its enactment\nand to all writings previously executed if the grantor is living at the time of its\nenactment.","path":["KRS Chapter 394"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36240","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:25Z","sha256":"2cd4e0c6f75448cd4a7ef652440b67bbb48e94666e30a28e3ccd80ff21f8c3c5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-394.060","next":"us-ky/krs-394.070"},"notice":"GroundRules: Original legal text.
