{"data":{"id":"us-ky/krs-394.076","jurisdiction":"us-ky","citation":"KRS 394.076","heading":"Uniform testamentary additions to trust act.","body":"(1) A will may validly transfer property to the trustee of a trust:\n(a) Established during the testator's lifetime by the testator, by the testator and one\n(1) or more other persons, or by one (1) or more other persons, including a\nfunded or unfunded life insu rance trust, although one (1) or more persons\nother than the trustee have reserved any or all rights of ownership of the\ninsurance contracts; or\n(b) Established at the testator's death by the testator's transfer to the trustee, if the\ntrust is identified i n the testator's will and its terms are set forth in a written\ninstrument, other than a will, executed before, concurrently with, or after the\nexecution of the testator's will or in another individual's will if that other\nindividual has predeceased the tes tator, regardless of the existence, size, or\ncharacter of the corpus of the trust.\n(2) A transfer referred to in subsection (1) of this section shall not be invalid because\nthe trust is amendable or revocable, or because the trust was amended after the\nexecution of the will or the testator's death.\n(3) Unless the testator's will provides otherwise, property transferred to a trust in\naccordance with subsection (1) of this section shall not be held under a testamentary\ntrust of the testator but shall become a part of the trust to which it is transferred. The\nproperty shall be administered and disposed of in accordance with the provisions of\nthe governing instrument setting forth the terms of the trust, including any\namendments to it made before or after the testator's death.\n(4) Unless the testator's will provides otherwise, a revocation or termination of the trust\nbefore the testator's death shall cause the devise or bequest to lapse.\n(5) This section shall be effective for any devise or bequest made by wills of decedents\ndying on or after July 15, 1998.\n(6) This section shall be construed to effectuate its general purpose to make uniform the\nlaw of those states that enact it.\n(7) This section may be cited as the Uniform Testamentary Additions to Trusts Act.","path":["KRS Chapter 394"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36243","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:25Z","sha256":"1aaea9b1ddc915563935f662c449d2dbef8de4450aad90ddbd5bd14bf6f4b5eb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-394.075","next":"us-ky/krs-394.080"},"notice":"GroundRules: Original legal text.
