{"data":{"id":"us-ky/krs-394.230","jurisdiction":"us-ky","citation":"KRS 394.230","heading":"Deposition of subscribing witness -- When and how may be taken.","body":"When any will or any authenticated copy, as provided in KRS 394.150, is offered for\nprobate, and an attesting witness resides out of this state, or though in the state is in\nconfinement in another county under legal process, or is unable from sickness, age  or\nother infirmity to attend the court before which the will or copy is offered, or resides at a\ndistance of more than fifty (50) miles, the court may cause a commission to be issued,\nannexed to the will or copy and directed to any person authorized to ta ke depositions, to\ntake his deposition. The deposition of such witness shall be taken and certified as\ndepositions are taken in other cases, except that no notice need be given of the time and\nplace of taking, unless the probate is opposed by some person w ho has made himself a\nparty.
