{"data":{"id":"us-ky/krs-394.300","jurisdiction":"us-ky","citation":"KRS 394.300","heading":"Recording of wills.","body":"(1) (a) Every will admitted to probate by any court shall be recorded by the county\nclerk, and shall remain in the office of the county clerk except:\n1. During such time as it may be carried to another court under subpoena\nduces tecum; or\n2. As provided in paragraph (d) of this subsection.\n(b) For any will recorded on or after January 1, 2027, the county clerk shall return\nthe will to the person designated in the order admitting the will to probate no\nearlier than two (2) years after it has been recorded by the county clerk.\n(c) Any will recorded with the county clerk after January 1, 1978, and prior to\nJanuary 1, 2027, that remains in the office of the county clerk may be\ndestroyed or returned to either the person designated in the order admitting the\nwill to proba te or the person appointed as the executor or executrix of the\ndecedent's estate no earlier than ten (10) years after the date of recording.\n(d) Upon receipt of any notice required under KRS 394.240, the county clerk\nshall not return a will under paragraph (b) or (c) of this subsection until:\n1. The adversarial proceeding is final and nonappealable; or\n2. Authorized by a court of competent jurisdiction.\n(e) Any attempted return of a will under paragraph (b) or (c) of this subsection\nthat is:\n1. Returned to the county clerk as undeliverable; or\n2. Precluded due to insufficient information regarding an address or to\nwhom the will should be returned;\nmay be destroyed.\n(2) (a) A will probated in the court of one Kentucky county and recorded in the\noffice of the county clerk for that county may be recorded in the office of the\ncounty clerk for other counties without the process of probate in the other\ncounty.\n(b) Production of an attested copy of the will together with an attested copy of the\norder of probate shall be required by the county clerk of the other county\nbefore recordation.\n(c) The clerk shall make the same charge for recordation as is otherwise provided\nfor recording a will.","path":["KRS Chapter 394"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57667","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:25Z","sha256":"b4da0374f8bd6416ba1aecbe16c4b28a6ccc3abb06671f1d3739cfe921ca7f7c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-394.295","next":"us-ky/krs-394.310"},"notice":"GroundRules: Original legal text.
