{"data":{"id":"us-ky/krs-394.382","jurisdiction":"us-ky","citation":"KRS 394.382","heading":"Share of pretermitted child.","body":"(1) If a testator fails to provide in his will for any of his children born or adopted after\nthe execution of his will, the omitted child receives a share in the estate equal in\nvalue to that which he would have received if the testator had died intestate unless:\n(a) It appears from the will that the omission was intentional;\n(b) When the will was executed the testator had one (1) or more children and\ndevised substantially all his estate to the other parent of the omitted child; or\n(c) The testator provided for  the child by transfers outside the will and the intent\nthat the transfers be in lieu of a testamentary provision is shown by statements\nof the testator or from the amount of the transfers or other evidence.\n(2) In satisfying a share provided for in this s ection, such share shall be taken ratably\nfrom the interest of heirs, devisees and legatees.","path":["KRS Chapter 394"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36281","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:26Z","sha256":"151b5478496038c59575827c455cf248a786bca31e0975a397fe73a0fb25ab59","source_id":"us-ky","stale":false,"prev":"us-ky/krs-394.380","next":"us-ky/krs-394.390"},"notice":"GroundRules: Original legal text.
