{"data":{"id":"us-ky/krs-394.720","jurisdiction":"us-ky","citation":"KRS 394.720","heading":"Definitions for KRS 394.720 to 394.750.","body":"As used in KRS 394.720 to 394.750:\n(1) \"Electronic\" has the same meaning as in KRS 394.700;\n(2) \"Electronic record\" means a record created, generated, sent, communicated,\nreceived, or stored by electronic means;\n(3) \"Electronic signature\" means an electronic symbol or process attached to or\nlogically associated with a record and executed or adopted by a person with the\nintent to sign the record;\n(4) \"Information\" includes data, text, images, codes, computer programs, software, and\ndatabases;\n(5) \"Nontestamentary estate planning document\" means a  record relating to estate\nplanning that is readable as text at the time of signing and is not a will or contained\nin a will. The term:\n(a) Includes a record readable as text at the time of signing that creates, exercises,\nmodifies, releases, or revokes:\n1. A trust instrument;\n2. A trust power that under the terms of the trust requires a signed record;\n3. A certification of a trust under KRS 386B.10-120;\n4. A power of attorney that is durable under KRS Chapter 457;\n5. An agent's certification under KRS 457.430;\n6. A power of appointment;\n7. An advance directive or medical order for scope of treatment under KRS\n311.621 to 311.643;\n8. A record directing disposition of an individual's body after death;\n9. A nomination of a guardian for the signing individual;\n10. A nomination of a guardian for a minor child or disabled adult child;\n11. An advance directive for mental health treatment under KRS 202A.420\nto 202A.432;\n12. A community property survivorship agreement;\n13. A disclaimer under KRS 394.035 or KRS 394.610 to 394.670; and\n14. Any other record intended to carry out an individual's intent regarding\nproperty or health care while incapacitated or on death; and\n(b) Does not include a deed of real property or certificate of title for a motor\nvehicle, watercraft, or aircraft;\n(6) \"Person\" has the same meaning as in KRS 386B.1-010;\n(7) \"Power of attorney\" means a record that grants authority to an agent in place of t he\nprincipal, even if the term is not used in the record;\n(8) \"Record\" has the same meaning as in KRS 394.700;\n(9) \"Security procedure\" means a procedure to verify that an electronic signature,\nrecord, or performance is that of a specific person or to dete ct a change or error in\nan electronic record. The term includes a procedure that uses an algorithm, code,\nidentifying word or number, encryption, or callback or other acknowledgment\nprocedure;\n(10) \"Settlor\" has the same meaning as in KRS 386B.1-010;\n(11) \"Sign\" has the same meaning as in KRS 394.700;\n(12) \"State\" has the same meaning as in KRS 386B.1-010;\n(13) \"Terms of a trust\" has the same meaning as in KRS 386B.1-010;\n(14) \"Trust instrument\" has the same meaning as in KRS 386B.1-010; and\n(15) \"Will\" has the same meaning as in KRS 394.010","path":["KRS Chapter 394"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57705","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:26Z","sha256":"4f78b9f83bfda41e11c6fbac5675fe888f87bd62186205522d520c4ea618195b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-394.715","next":"us-ky/krs-394.722"},"notice":"GroundRules: Original legal text.
