{"data":{"id":"us-ky/krs-395.160","jurisdiction":"us-ky","citation":"KRS 395.160","heading":"Removal of representatives.","body":"(1) If a personal representative moves out of the state and fails to designate a process\nagent as required by KRS 395.015, becomes insane or otherwise incapable to\ndischarge the trust, goes bankrupt or insolvent or is in failing circumstances, the\nDistrict Cou rt shall remove him or her, and the other personal representative, if\nthere is another, shall discharge the trust. If he or she resides in the county of his or\nher appointment or in an adjoining county, and is not insane, he or she shall have\nten (10) days' notice before the order of removal is made. If he or she is insane, the\nnotice shall be given to his or her committee, if he or her has one, and if there is no\ncommittee, the court may appoint one.\n(2) The district court may remove a personal representat ive for failing to give\nadditional security when required under KRS 62.060 and appoint another.\n(3) The court shall require a personal representative who is removed to settle his\naccounts, and deliver over the decedent's estate to the person appointed in his stead.","path":["KRS Chapter 395"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57787","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:26Z","sha256":"7f41402197404799ea3de8e94ed15429e6054623eebe2022df37b3c5f137b09e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-395.155","next":"us-ky/krs-395.170"},"notice":"GroundRules: Original legal text.
