{"data":{"id":"us-ky/krs-395.170","jurisdiction":"us-ky","citation":"KRS 395.170","heading":"Nonresident representatives -- Bond -- Actions by.","body":"(1) By giving bond, with surety that is resident of the county in which the action is\nbrought, nonresident executors or administrators of persons who were nonresidents\nat the time of their death may prosecute actions for the recovery of debts due to such\ndecedents.\n(2) In such actions the plaintiff's letters testamentary or letters of administration,\ngranted by a competent tribunal, properly authenticated, shall be filed. No judgment\nshall be rendered until the plaintiff executes bond to the state, with good s urety that\nis resident of the county, conditioned to pay any debt due by his decedent to any\nresident of this state to the extent assets come to his hands.\n(3) Actions may be brought on the bond required by subsection (2) for the use of any\ncreditor of the decedent for three years after the date of each receipt of assets by the\nexecutor or administrator in this state but not after.\n(4) If there is an executor or administrator of such a decedent qualified by a court of\nthis state, he alone may sue, but any  debtor who pays his debt or part of it to a\nnonresident personal representative without notice of the resident personal\nrepresentative shall be discharged to the extent of such payment.","path":["KRS Chapter 395"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36331","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:26Z","sha256":"add41daeb43994c4413386c2ff607461a4707f9ce5171f6ba04541ca12f226e4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-395.160","next":"us-ky/krs-395.180"},"notice":"GroundRules: Original legal text.
