{"data":{"id":"us-ky/krs-395.455","jurisdiction":"us-ky","citation":"KRS 395.455","heading":"Transfer of assets without administration.","body":"(1) Where the exemption for the surviving spouse or children, alone or together with\npreferred claims, paid by either the surviving spouse or children or by the surviving\nspouse where the surviving spouse's estate is legally liable for payment, equals or\nexceeds the amount of distributable assets, the court may order that administration\nof the estate be dispensed with and the assets be transferred to the surviving spouse\nor, if there is no surviving spouse, to the surviving children, or to a person\ndesignated by the surviving spouse. The court may order that administration of the\nestate be dispensed with in both testate and intestate estates without requiring the\nrenunciation of a will.\n(2) If the court is satisfied that no distributable estate will pass through  the hands of the\npersonal representative, it may order that no letters of administration be issued and\nin the case of a testate estate, order that the will be probated only.\n(3) The court may order that the administration of the estate be dispensed with a nd the\nassets transferred in favor of a preferred creditor or other person where:\n(a) A surviving spouse or, if there is no surviving spouse, the surviving children\nhave waived the exemption accorded by law in favor of a person who has paid\npreferred claim s in an amount equaling or exceeding the amount of\ndistributable assets or who is legally entitled to payment; or\n(b) There is no surviving spouse or surviving children, and another person has\npaid preferred claims or is legally entitled to payment.\n(4) For purposes of this section, the exemption for the surviving spouse and children\nshall be the exemption created by KRS 391.030, and preferred claims shall be those\nlisted in KRS 396.095 and in the order listed.","path":["KRS Chapter 395"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57684","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:27Z","sha256":"20e42de0b61cef0f2bec5fe61a3a25872b79ea735fc03d1bbf89bafbbf5f3f23","source_id":"us-ky","stale":false,"prev":"us-ky/krs-395.450","next":"us-ky/krs-395.460"},"notice":"GroundRules: Original legal text.
