{"data":{"id":"us-ky/krs-395.617","jurisdiction":"us-ky","citation":"KRS 395.617","heading":"Proposed periodic or final settlement -- Requirements.","body":"(1) A fiduciary may, prior to filing a periodic or final settlement and prior to a\ndistribution of assets, file with the court a proposed periodic or final settlement\nwithin the time prescribed for filing settlements in KRS 395.610.\n(2) The proposed settlement shall be set for hearing, and in addition to the notice given\nas provided in KRS 395.625 as for any other settlement, the fiduciary shall notify\nall beneficiaries of the estate, other than nonresiduary legatees who have received\nand receipted for their l egacies, by certified mail, return receipt requested, at least\ntwenty (20) days prior to the hearing date.\n(3) The proposed settlement shall comply with the requirements for periodic and final\nsettlements in KRS 395.610, except the proposed settlement sha ll also indicate any\nassets anticipated to be received subsequent to filing the proposed settlement and\nprior to the filing of the periodic or final settlement and the proposed distribution of\nall or a portion of the assets. Documentation supporting receip ts and past\ndisbursements shall not be required to be filed with the proposed settlement unless\nordered by the court if exceptions are filed.\n(4) At the hearing, if no exceptions are filed, the proposal, if made according to law,\nshall be approved. If exc eptions are filed, other evidence besides that reported may\nbe heard, and the court shall, upon the whole case, reject, confirm, alter, or amend\nthe proposal.\n(5) Following the entry of an order approving, confirming, or amending the proposed\nsettlement, the fiduciary shall disburse the assets in accordance with the order.\nFollowing the distribution, the fiduciary shall file a settlement accompanied by\ndocumentation showing that distribution was effected in conformity with the order\napproving, confirming, or amending.\n(6) An aggrieved party may, no later than thirty (30) days from the entry of the order\nupon the proposed settlement, institute an adversary proceeding in Circuit Court\npursuant to KRS 24A.120(2).","path":["KRS Chapter 395"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57688","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:27Z","sha256":"f75ff5552c13f36235ebebfaebd6d0bdc69812d1bd0a6f39ec6eeec321a33dab","source_id":"us-ky","stale":false,"prev":"us-ky/krs-395.615","next":"us-ky/krs-395.620"},"notice":"GroundRules: Original legal text.
