{"data":{"id":"us-ky/krs-395a.060","jurisdiction":"us-ky","citation":"KRS 395A.060","heading":"Procedure for disclosing digital assets.","body":"(1) When disclosing digital assets of a user under this chapter, the custodian may at its\nsole discretion:\n(a) Grant a fiduciary or designated recipient full access to the user's account;\n(b) Grant a fiduciary or designated recipient partial access to the user 's account\nsufficient to perform the tasks with which the fiduciary or designated recipient\nis charged; or\n(c) Provide a fiduciary or designated recipient a copy in a record of any digital\nasset that, on the date the custodian received the request for disc losure, the\nuser could have accessed if the user were alive and had full capacity and\naccess to the account.\n(2) A custodian may assess a reasonable administrative charge for the cost of disclosing\ndigital assets under this chapter, unless the user would h ave had access to those\ndigital assets for free or for no additional charge.\n(3) A custodian need not disclose under this chapter a digital asset deleted by a user.\n(4) If a user directs or a fiduciary requests a custodian to disclose under this chapter\nsome, but not all, of the user's digital assets, the custodian need not disclose the\nassets if segregation of the assets would impose an undue burden on the custodian.\nIf the custodian believes the direction or request imposes an undue burden, the\ncustodian or fiduciary may seek an order from the court to disclose:\n(a) A subset limited by date of the user's digital assets;\n(b) All of the user's digital assets to the fiduciary or designated recipient;\n(c) None of the user's digital assets; or\n(d) All of the user's digital assets to the court for review in camera.","path":["KRS Chapter 395A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51169","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:27Z","sha256":"976280eb86a566756980ba8cc1265dfc567d81a090c7aa48b153db858ae73fa9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-395a.050","next":"us-ky/krs-395a.070"},"notice":"GroundRules: Original legal text.
