{"data":{"id":"us-ky/krs-395a.120","jurisdiction":"us-ky","citation":"KRS 395A.120","heading":"Disclosure of contents of electronic communications held in trust when","body":"trustee is not original user.\nUnless otherwise ordered by the court, directed by the user, or provided in a trust, a\ncustodian shall disclose to a trustee that is not an original user of an account the content\nof an electronic communication sent or received by an original or successor user and\ncarried, maintained, processed, received, or stored by the custodian in the account of the\ntrust if the trustee gives the custodian:\n(1) A written request for disclosure in physical or electronic form;\n(2) A certified copy of the trust instrument or a certification of the trust under KRS\n386B.10-120 that includes consent to disclosure of the content of electronic\ncommunications to the trustee;\n(3) A certification by the trustee, under penalty of perjury, that the trust exists and the\ntrustee is a currently acting trustee of the trust; and\n(4) If requested by the custodian:\n(a) A number, username, address, or other unique subscriber or account identifier\nassigned by the custodian to identify the trust's account; or\n(b) Evidence linking the account to the trust.","path":["KRS Chapter 395A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50230","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:27Z","sha256":"459d86de720b229dfa5a6208f5a0618f400aa8073a2a5fe771aeeee3bf8bc59d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-395a.110","next":"us-ky/krs-395a.130"},"notice":"GroundRules: Original legal text.
