{"data":{"id":"us-ky/krs-395a.160","jurisdiction":"us-ky","citation":"KRS 395A.160","heading":"Custodian compliance and authority.","body":"(1) Not later than sixty (60) days after receipt of the information required under KRS\n395A.070 to 395A.150, a custodian shall comply with a request under this chapter\nfrom a fiduciary or designated recipient to disclose digital assets or terminate an\naccount. If the custodian fails to comply, the fiduciary or designated recipient may\napply to the court for an order directing compliance.\n(2) An order under subsection (1) of this section directing compliance shall contain a\nfinding that compliance is not in violation of 18 U.S.C. sec. 2702, as amended.\n(3) A custodian may notify the user that a request for disclosure or to terminate an\naccount was made under this chapter.\n(4) A custodian may deny a request under this chapter from a fiduciary or designated\nrecipient for disclosure of digital assets or to terminate an account, if the custodian\nis aware of any lawful access to the account following the receipt of the fiduciary's\nrequest.\n(5) This chapter does not limit a custodian's ability to obtain or require a fid uciary or\ndesignated recipient requesting disclosure or termination under this chapter to\nobtain a court order which:\n(a) Specifies that an account belongs to the protected person or principal;\n(b) Specifies that there is sufficient consent from the protected person or principal\nto support the requested disclosure; and\n(c) Contains a finding required by law other than this chapter.\n(6) A custodian and its officers, employees, and agents are immune from liability for an\nact or omission done in good faith in compliance with this chapter.","path":["KRS Chapter 395A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50234","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:27Z","sha256":"2d687e4899e1b2a83c7efa30c7e3a3949f0fbc358fb9093af547a79545f1b674","source_id":"us-ky","stale":false,"prev":"us-ky/krs-395a.150","next":"us-ky/krs-395a.170"},"notice":"GroundRules: Original legal text.
