{"data":{"id":"us-ky/krs-396.011","jurisdiction":"us-ky","citation":"KRS 396.011","heading":"Presentation of claims against estate -- Time limitations -- Exceptions.","body":"(1) All claims against a decedent's estate which arose before the death of the decedent,\nexcluding claims of the United States, the State of Kentucky and any subdivi sion\nthereof, whether due or to become due, absolute or contingent, liquidated or\nunliquidated, founded on contract, tort, or other legal basis, if not barred earlier by\nother statute of limitations, are barred against the estate, the personal representati ve,\nand the heirs and devisees, unless presented within six (6) months after the\nappointment of the personal representative, or where no personal representative has\nbeen appointed, within two (2) years after the decedent's death.\n(2) Nothing in this section shall affect or prevent:\n(a) To the extent of the security only, any proceeding to enforce any mortgage,\npledge, lien or other security interest securing an obligation of the decedent or\nupon property of the estate; or\n(b) To the limits of the insurance protection only, any proceeding to establish\nliability of the decedent or the personal representative for which he is\nprotected by liability insurance.","path":["KRS Chapter 396"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51057","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:27Z","sha256":"95c70317d3174c47598daa6a542a342bffcea226141ad611e7e4d7db13193c51","source_id":"us-ky","stale":false,"prev":"us-ky/krs-396.010","next":"us-ky/krs-396.012"},"notice":"GroundRules: Original legal text.
