{"data":{"id":"us-ky/krs-396.055","jurisdiction":"us-ky","citation":"KRS 396.055","heading":"Allowance or disallowance of claims -- Notice -- Effect.","body":"(1) As to claims presented in the manner described in KRS 396.015 within the time\nlimit prescribed in KRS 396.011, the personal representative may mail a notice to\nany claimant stating that the claim has been allowed or disallowed. If, after allowing\nor disallowing a claim, the personal representative changes his decision concerning\nthe claim, he shall notify the claimant. The personal representative may not change\na disallowance of a claim after the time for the claimant to commence an action on\nthe claim has run and the claim has been barred. Every claim which is disallowed in\nwhole or in part by the personal representative is barred so far as not allowed unless\nthe claimant commences an action against the personal representative not later than\nsixty (60) days after the mailing of the notice of disallowance or partial allowance if\nthe notice warns the claimant of the impending bar. Failure of the personal\nrepresentative to mail notice to a claimant of action on his claim for sixty (60) days\nafter the time for o riginal presentation of the claim has expired has the effect of a\nnotice of allowance, except that upon petition of the personal representative and\nupon notice to the claimant, the court at any time before payment of such claim may\nfor cause shown permit the personal representative to disallow such claim.\n(2) A judgment against a personal representative to enforce a claim against a decedent's\nestate is an allowance of the claim.\n(3) In the case of a disallowance of a claim which has not matured or which is\ncontingent or unliquidated, the personal representative may consent to an extension\nof the sixty (60) day period imposed by subsection (1) of this section for the\ncommencement of an action on a disallowed claim, or to avoid injustice, the court,\non petitio n, may order an extension of the sixty (60) day period, but in no event\nshall the extension run beyond the applicable statute of limitations.","path":["KRS Chapter 396"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36414","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:28Z","sha256":"d58269f3c755684261e16b7faef9b7f3a810cd729cc6e5a225f1ae7772fd794e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-396.050","next":"us-ky/krs-396.060"},"notice":"GroundRules: Original legal text.
