{"data":{"id":"us-ky/krs-396.075","jurisdiction":"us-ky","citation":"KRS 396.075","heading":"Payment of claims.","body":"(1) Upon the expiration of six (6) months from the date of his appointment, the\npersonal representative may proceed to pay the claims allowed against the estate in\nthe order of priority prescribed, after making appropriate provision for exemptions\nand allowances provided by law, for claims already presented which have not yet\nbeen allowed and for unbarred claims which may yet be presented, including costs\nand expenses of administration. By petition to the court in a proceeding for the\npurpose, a claimant whose claim has been allowed but not paid as provided herein\nmay secure an order directing the personal representative to pay the claim to the\nextent that funds of the estate are available for the payment.\n(2) The personal representative at any time may pay any just claim which has not been\nbarred, with or without formal presentation, but he is personally liable to any other\nclaimant whose claim is allowed and who is injured by such payment if:\n(a) The payment was made before the expiration of the time limit stat ed in\nsubsection (1) of this section and the personal representative failed to require\nthe payee to give adequate security for the refund of any of the payment\nnecessary to pay other claimants; or\n(b) The payment was made, due to the negligence or willful fault of the personal\nrepresentative, in such manner as to deprive the injured claimant of his\npriority.","path":["KRS Chapter 396"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36418","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:28Z","sha256":"fd47ac5e6b0d35071b6d1dbd51f87fb93b349587ae144ca99410c75e59f5d33c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-396.070","next":"us-ky/krs-396.080"},"notice":"GroundRules: Original legal text.
