{"data":{"id":"us-ky/krs-396.175","jurisdiction":"us-ky","citation":"KRS 396.175","heading":"Proportionate payment of claims.","body":"(1) All assets of estates being administered in this state are subject to all claims,\nallowances and charges existing or established against the personal representative\nwherever appointed.\n(2) If the estate either in this state or as a whole is insufficient to  cover all exemptions\nand allowances determined by the law of the decedent's domicile, prior charges and\nclaims, after satisfaction of the exemptions, allowances, and charges, each claimant\nwhose claim has been allowed either in this state or elsewhere in administrations of\nwhich the personal representative is aware, is entitled to receive payment of an\nequal proportion of his claim. If a preference or security in regard to a claim is\nallowed in another jurisdiction but not in this state, the creditor so be nefited shall\nreceive payment out of local assets only upon the balance of his claim after\ndeducting the amount of the benefit.\n(3) In case the exemptions and allowances, prior charges and claims of the entire estate\nexceed the total value of the portions of the estate being administered separately and\nthis state is not the state of the decedent's last domicile, the claims allowed in this\nstate shall be paid their proportion if local assets are adequate for the purpose, and\nthe balance of local assets shall  be transferred to the domiciliary personal\nrepresentative. If local assets are not sufficient to pay all claims allowed in this state\nin the amount to which they are entitled, local assets shall be marshaled so that each\nclaim allowed in this state is pai d its proportion as far as possible, after taking into\naccount all payments on claims allowed in this state from assets in other\njurisdictions.","path":["KRS Chapter 396"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36438","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:28Z","sha256":"9679a9bdaacc036f22e4cfa1f62da7ea5dec7b6b16f296cc5b83ed7b7ef278c7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-396.170","next":"us-ky/krs-396.180"},"notice":"GroundRules: Original legal text.
