{"data":{"id":"us-ky/krs-396.185","jurisdiction":"us-ky","citation":"KRS 396.185","heading":"Liability of personal representative.","body":"(1) Unless otherwise provided in the contract, a personal representative is not\nindividually liable on a contract properly entered into in his fiduciary capacity in the\ncourse of administration of the estate unless he fails to reveal his representative\ncapacity and identify the estate in the contract.\n(2) A personal representative is individually liable for obligations arising from\nownership or control of the estate or for torts committed in the course of\nadministration of the estate only if he is personally at fault.\n(3) Claims based on contracts entered into by a personal representative in his fiduciary\ncapacity, on obligations arising from ownership or control of the estate or on torts\ncommitted in the course of estate administration may be asserted against t he estate\nby proceeding against the personal representative in his fiduciary capacity, whether\nor not the personal representative is individually liable therefor.\n(4) Issues of liability as between the estate and the personal representative individually\nmay be determined in a proceeding for accounting, surcharge or indemnification or\nother appropriate proceeding.","path":["KRS Chapter 396"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36440","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:28Z","sha256":"d1b91eef0510f39dc74f6429199c0a6f2cd8b52e74fcab9fdcb3db4cb1c4780c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-396.180","next":"us-ky/krs-396.195"},"notice":"GroundRules: Original legal text.
