{"data":{"id":"us-ky/krs-39a.030","jurisdiction":"us-ky","citation":"KRS 39A.030","heading":"Rationale and purpose of program -- Division of Emergency Management.","body":"The General Assembly recognizes that the rationale and purpose of the comprehensive\nemergency management program of the Commonwealth has evolved from a program for\nresponse to threats to national security, enemy attack, and other national defense needs, to\na program for response to all hazards, but primarily, domestic hazards and threats\nincluding natural, man -made, technological, industrial, or environmental emergencies or\ndisasters, for which civil government is primarily responsible. Because of major cha nges\nin the rationale and necessity for emergency management capabilities, as well as the\nurgent requirement for multiagency participation and inter -agency coordination to ensure\ntimely, effective, and appropriate disaster and emergency response in the Commonwealth,\nand to otherwise modernize and improve the administration, effectiveness, and relevance\nof the comprehensive emergency management program for the contemporary needs of the\ncitizens of the Commonwealth, the General Assembly declares:\n(1) A Divisi on of Emergency Management is hereby created as the emergency\nmanagement agency of state government which shall develop the comprehensive\nemergency management program of the Commonwealth on behalf of the Governor,\nand in consultation with the cabinet secre taries of state government, other\nappropriate state agency heads, local elected chief executives, local emergency\nmanagement directors, and local emergency planning committees, for the purpose\nof developing and enhancing comprehensive emergency management program\npolicies, plans, or procedures to provide for a coordinated responsive, and\nintegrated emergency management system in the Commonwealth;\n(2) The division may accept on behalf of the Commonwealth any grant, contribution, or\nfund, federal or otherwise , made to assist in meeting the costs of carrying out the\nprovisions and purposes of KRS Chapters 39A to 39F, and fully comply with all\nfunding requirements imposed by the receipt and use of the grant, contribution, or\nfund; and\n(3) The term \"Division of E mergency Management\" shall constitute and designate the\nofficial name of the emergency management agency of state government created\npursuant to subsection (1) of this section and \"Division of Emergency\nManagement,\" in the exact order or form as specified in this subsection, shall not be\nutilized by or assigned to any other agency of state or local government, or other\nstate or local entity, or any political subdivision of the Commonwealth to constitute\nor designate the official name of any such agency, entity, or political subdivision.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21697","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:57Z","sha256":"28a133fcd163303c5557eccfedb788868d0d210bd06c3af1f3d8b00c49e874c6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.020","next":"us-ky/krs-39a.040"},"notice":"GroundRules: Original legal text.
