{"data":{"id":"us-ky/krs-39a.090","jurisdiction":"us-ky","citation":"KRS 39A.090","heading":"Executive actions -- Time limit on directives issued by Governor --","body":"Extensions  and modifications -- Approval and termination by General\nAssembly  -- Waiver of immunity.\n(1) The  Governor may  make, amend,  and rescind any executive actions as\ndeemed  necessary to carry out the provisions of KRS Chapters 39A to 39F.\n(2) (a) Executive orders, administrative regulations, or other directives issued\nunder this chapter by the Governor shall be in effect no longer than thirty\n(30) days unless an extension, modification, or termination is approved by\nthe General Assembly prior to the extension of any executive order or\ndirective that:\n1. Places restrictions on the in-person meeting or places restrictions on\nthe functioning of the following:\na. Elementary,  secondary,  or  postsecondary  educational\ninstitutions;\nb. Private businesses or nonprofit organizations;\nc. Political, religious, or social gatherings;\nd. Places of worship; or\ne. Local governments; or\n2. Imposes mandatory quarantine or isolation requirements.\n(b) All other executive orders, administrative regulations, or directives that\nare not described in paragraph (a) of this subsection may exceed thirty\n(30) days if requested by a chief executive officer or a legislative body of\na local government only for that local government and only for the period\nof time requested by the chief executive officer or a legislative body. The\nchief executive officer or a legislative body may make a written request for\nextensions or early termination of the executive order.\n(3) Upon  the expiration of an executive order or other directive described in\nsubsection  (2)(a) of  this section declaring an  emergency  or  other\nimplementation of powers under this chapter, the Governor shall not declare a\nnew  emergency or continue to implement any of the powers enumerated in this\nchapter based upon the same or substantially similar facts and circumstances\nas the original declaration or implementation without the prior approval of the\nGeneral Assembly.\n(4) The  General Assembly, by joint resolution, may  terminate a declaration of\nemergency at any time.\n(5) The Commonwealth  waives immunity for prospective equitable and declaratory\nrelief only, under the Eleventh Amendment  to the Constitution of the United\nStates for cases brought against it in federal jurisdictions pursuant to KRS\n446.350 during emergencies declared under KRS  Chapters 39A to 39F. No\naward of monetary damages, costs, or attorney fees is waived or authorized\nunder this subsection.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50905","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"5e473303b91fec55dee906684ba762eacd32e13099e8983b1109c1405682a973","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.080","next":"us-ky/krs-39a.100"},"notice":"GroundRules: Original legal text.
