{"data":{"id":"us-ky/krs-39a.170","jurisdiction":"us-ky","citation":"KRS 39A.170","heading":"Lease or loan of real or personal property of state government -- Disaster","body":"and emergency response activities of state employees.\n(1) Notwithstanding any inconsistent provision of law, the Governor may, when it is\nfound to be in the public interest:\n(a) Authorize any division or agency of the state to lease or lend, on such terms\nand conditions as deemed necessary to promote the public welfare and protect\nthe interests of the state, any real or personal property of the state government\nto the President of the United States, the chiefs of the Armed Forces, or to the\nFederal Emergency Management Agency;\n(b) Enter into a contract on behalf of the state for the lease or loan to any political\nsubdivision of the state on such terms and conditions as may be dee med\nnecessary to promote the public welfare and protect the interests of the state,\nof any real or personal property of the state government, or the temporary\ntransfer or employment of personnel of the state government to or by any\npolitical subdivision of the state; and\n(c) Permit state employees to engage in disaster and emergency response\nactivities, within or without the state, for the division, or for a local\njurisdiction upon request of a local emergency management agency to the\ndivision. State employ ees assigned to or volunteering for this duty shall be\nconsidered as being employed by the agency by which they are regularly\nemployed and shall continue to receive salary and benefits while engaging in\ndisaster and emergency response work.\n(2) The permiss ion of the Governor for the use of state employees in the manner\nspecified in subsection (1)(c) of this section shall be presumed, and shall be\nautomatic unless the Governor specifies otherwise with regard to the use of a\nspecific employee or employees.\n(3) The Chief Justice for the Court of Justice and the Director of the Legislative\nResearch Commission, with regard to employees of their respective branches of\ngovernment, may permit Court of Justice and legislative employees to engage in\ndisaster and emerg ency services work under the same terms and conditions as\nspecified in subsections (1) and (2) of this section.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21711","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"9548cd93fcd1aa2d6f5193b9dcd508fb416b9c6a5ec860c81425684d9ff3869a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.160","next":"us-ky/krs-39a.180"},"notice":"GroundRules: Original legal text.
