{"data":{"id":"us-ky/krs-39a.180","jurisdiction":"us-ky","citation":"KRS 39A.180","heading":"Orders and administrative regulations of Governor, agencies, and","body":"political subdivisions -- Suspension  of  statutes -- Conformity  of\nadministrative regulations -- Enforcement.\n(1) The  political subdivisions of the state and other agencies designated or\nappointed by the Governor may  make,  amend,  and  rescind orders and\npromulgate administrative regulations necessary for disaster and emergency\nresponse purposes, and to supplement the carrying out of the provisions of this\nchapter, if not inconsistent with any orders or administrative regulations\npromulgated by the Governor or by any state agency exercising a power\ndelegated to it by the Governor.\n(2) (a) All written orders and administrative regulations promulgated by the\nGovernor, the director, or by any political subdivision or other agency\nauthorized by KRS  Chapters 39A to 39F to make orders and promulgate\nadministrative regulations, shall have  the full force of law and, if\npromulgated as administrative regulations, shall follow the requirements\nfor promulgating administrative regulations under KRS  Chapter 13A. All\nwritten orders authorized by KRS  Chapters 39A to 39F shall be filed with\nthe Legislative Research Commission.\n(b) The  Governor may  suspend a statute by executive order when  an\nemergency is declared under this chapter if:\n1. The  statute is specifically enumerated  by the Governor in the\nexecutive order; and\n2. The  executive order specifying the suspension is approved by the\nAttorney General in writing.\n(c) A statute suspension authorized in paragraph (b) of this subsection shall\nonly be in effect while the emergency executive order is in effect.\n(d) Any  existing administrative regulation that conflicts with a written order\nissued under this chapter shall be amended, withdrawn, or repealed in\naccordance with KRS Chapter 13A to conform with the written order.\n(e) When  a written order ends, any administrative regulation promulgated\nunder the authority of this section shall:\n1. Become  void; and\n2. Be  withdrawn, amended,  or repealed in accordance with KRS\nChapter 13A.\n(3) Notwithstanding subsection (2) of this section, the Governor shall not suspend\nany  laws in KRS  Chapters 39A  to 39F, Chapter 13A, 446.350, 527.020,\n311.710 to 311.820, or any other statutes related to abortion.\n(4) The  law  enforcement  authorities of the  state and  of its counties,\nurban-counties, charter counties, and cities shall enforce the written orders and\nadministrative regulations issued pursuant to KRS Chapters 39A to 39F.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50620","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"be539c98bed12a5ccaae75263db23ddf904e6af3fb2e406e5d3f56a7fb948892","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.170","next":"us-ky/krs-39a.190"},"notice":"GroundRules: Original legal text.
