{"data":{"id":"us-ky/krs-39a.220","jurisdiction":"us-ky","citation":"KRS 39A.220","heading":"Agency emergency operations procedures.","body":"(1) Each agency, board, or commission of state government, unless the requirement is\nwaived, in writing, by the director, shall develop agency emergency operations\nprocedures which are consistent with and which meet the requirements of the\nKentucky Emergency O perations Plan. The agency emergency operations\nprocedures shall be updated not less than yearly.\n(2) Each agency, board, or commission of state government shall take those measures\nnecessary to ensure that it can continue to operate during times of disast er or\nemergency, that it can protect its vital records, and that it has designated at least\nfour (4) persons, preferably by title, who may act for the agency, and for its major\ncomponent operations, during an emergency or disaster if the primary person wit h\nthe power to make necessary decisions is unavailable for any reason.\n(3) In carrying out the provisions of subsections (1) and (2) of this section, each agency,\nboard, or commission of state government shall follow the general planning\nguidance of the di vision and the requirements of administrative regulations\npromulgated by the division.\n(4) Each agency, board, or commission of state government shall train its employees\nwith regard to the contents of the agency emergency operations procedures, and\nshall give any additional training necessary to implement the procedures during\ntimes of emergency or disaster.\n(5) Each agency, board, or commission of state government shall, upon request of the\ndirector, send an employee of the agency with full authority to t ake any action on\nbehalf of the agency to the State Emergency Operations Center, area offices of the\ndivision, state command posts or other designated location during periods of\nemergency or disaster.\n(6) As used in this section, agency, board, or commission means all agencies, unless the\nrequirement is waived, in writing, by the director, listed in KRS 12.020, other state\nbodies created by executive order of the Governor, the Legislative Research\nCommission, and the Court of Justice and its agencies.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21716","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"fec68d9e094ff22bc702c2d059e1075b97e0304a75b5ab0d395f1c66b5728c47","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.210","next":"us-ky/krs-39a.230"},"notice":"GroundRules: Original legal text.
