{"data":{"id":"us-ky/krs-39a.245","jurisdiction":"us-ky","citation":"KRS 39A.245","heading":"Kentucky Urban Search and Rescue Program -- Duties -- Employment --","body":"Administrative regulations -- Fund.\n(1) The Division of Emergency Management shall establish the Kentucky Urban\nSearch and Rescue Program.\n(2) The Kentucky Urban Search and R escue Program shall develop, coordinate,\nrespond to, and maintain the Commonwealth's efforts toward providing resources to\nlocate and extricate victims entrapped by man -made or natural disasters as well as\nconducting other operations within the boundaries of the Commonwealth or in\ncoordinated response with other states or the federal government. This program\nshall function in addition to and shall not supplant other disaster and emergency\nresponse efforts in this chapter.\n(3) The director of the Division of  Emergency Management shall employ an individual\nto assist with the administrative requirements associated with the establishment and\nmaintenance of the Kentucky Urban Search and Rescue Program, who shall report\ndirectly to the director. The director shall  employ other personnel to assist in the\noperations of the program, including personnel overseeing urban search and rescue\noperations, planning, and logistics. In addition, the division shall provide technical,\nclerical, and administrative assistance for t he program, together with necessary\noffice space and facilities that shall include necessary training facilities and\nwarehouses for equipment and personnel, and shall provide any other services and\nsupport necessary for the program to perform its functions.\n(4) (a) The division shall develop policies and procedures for the following:\n1. Organization and decision -making processes to establish lines of\nauthority and control, goals, and objectives required to accomplish\nmissions of the program response teams;\n2. Membership of the response teams;\n3. Staffing, in the administrative capacities of the program and of the\nresponse teams themselves;\n4. Participation and qualification requirements of response team members,\nincluding but not limited to training, meeting  times, skills and abilities,\nremovals, and resignations;\n5. Uniforms and equipment;\n6. Discipline and professional conduct of response teams;\n7. Operations of the division in relation to response teams, including but\nnot limited to mobilization, deployment, and bases of operation; and\n8. Any other issues concerning the operation of the program.\n(b) The division shall promulgate administrative regul ations in accordance with\nKRS Chapter 13A for the following:\n1. Accidents and injuries of response team members, who shall be covered\nby workers' compensation benefits paid by the division when responding\nto, performing, or returning from urban search and rescue operations\nthat are authorized by the division and when those individuals have\nregistered for benefits as required by the division;\n2. Procedures for the reimbursement of agencies participating in the\nprogram for expenses related to response team deployment; and\n3. Any other issues concerning the operation of the program.\n(5) (a) There is hereby established in the State Treasury a restricted fund to be known\nas the Kentucky Urban Search and Rescue Program fund.\n(b) The fund shall consist of moneys re ceived from grants, gifts, state\nappropriations, and federal funds.\n(c) The fund shall be administered by the division.\n(d) Amounts in the fund shall be used only for the administration of the program.\n(e) Notwithstanding KRS 45.229, fund amounts not expen ded at the close of a\nfiscal year shall not lapse but shall be carried forward to the next fiscal year.\n(f) Any interest earnings of the fund shall become a part of the fund and shall not\nlapse.\n(g) Moneys deposited in the fund are hereby appropriated for the purposes set\nforth in this section and shall not be appropriated or transferred by the General\nAssembly for any other purposes.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53993","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"c7bca9bd38619f18727519ea69bd4ddd1b4ca10b73704a01ad9ce5fe40fecd81","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.240","next":"us-ky/krs-39a.250"},"notice":"GroundRules: Original legal text.
