{"data":{"id":"us-ky/krs-39a.260","jurisdiction":"us-ky","citation":"KRS 39A.260","heading":"Mutual aid agreements with other states -- Workers' compensation.","body":"(1) The division may enter into agreements with other states with regard to mutual aid\nfor routine provision of emergency management services or for mutual aid during\ntimes of emergency or disaster, or any combination of these.\n(2) Kentucky emergency managemen t personnel, either working for the state or local\ngovernment or affiliated with the state or a local government, paid or volunteer,\nshall, to the extent provided by the law of the host state, have the same rights and\nprivileges as they have in Kentucky.\n(3) Emergency management personnel, either working for the state or a local\ngovernment or affiliated with the state or a local government of another state, paid\nor volunteer, shall, to the extent provided by Kentucky law, have the same rights\nand privileges as do Kentucky emergency management personnel working for the\nstate or local government or affiliated with the state or a local government, whether\npaid or volunteer. This provision shall not apply to the provision of peace officer\nservices, unless approv ed in writing by the Governor, or the General Assembly, as\nappropriate for the specific incident.\n(4) Kentucky emergency management-provided workers' compensation shall apply to a\nstate or local emergency management agency worker, paid or volunteer, or wor ker\nin an operating unit officially affiliated with the division, or worker in a local\nemergency management agency-supervised operating unit officially affiliated with a\nlocal disaster and emergency services organization pursuant to KRS 39B.070, who\nis ser ving in another state pursuant to an agreement consummated under this\nsection.\n(5) An emergency management worker from another state, paid or volunteer, who is\nworking for or affiliated with the state emergency management agency and who is\nserving in Kentucky pursuant to an agreement consummated under this section may\nbe accorded Kentucky emergency management workers' compensation coverage by\naction of the director.\n(6) The provisions of subsections (4) and (5) of this section shall not apply to hazardous\nmaterials emergency response operations defined in 29 C.F.R. 1910.120 which are\nabove the first -responder operations level, on -scene incident commander level\nexcluded.\n(7) An emergency management worker from another state, paid or volunteer, who is\nworking for the state emergency management agency or a local emergency\nmanagement agency or a worker in an organization affiliated with the state or local\nemergency management agency of another state who holds license or certification\nfrom the worker's state to practice a profession, or paraprofessional activity, or other\nactivity for which a license or certification is required to practice that activity in\nKentucky shall be, for the period of that work, under an agreement consummated\npursuant to this chapter, cons idered as properly licensed or certified in Kentucky to\nperform the services granted by the worker's license or certification. The worker\nshall, however, while in Kentucky, be subject to discipline by the appropriate\nKentucky licensing or certifying agency for acts of misconduct or negligence which\nare committed in Kentucky.\n(8) City, county, urban -county, or charter county emergency management agencies in\nKentucky may make written agreements with similar local emergency management\nagencies in adjoining sta tes if the agreements are submitted to the state emergency\nmanagement agencies of both states and are approved in writing by the directors of\nboth agencies. Agreements pursuant to this section shall be subject to the same\nrights and privileges as state agr eements under this section, but shall be limited to\ntwo (2) years, unless renewed by submission of a new agreement for approval.\n(9) The provisions of this section shall be subject to the provisions of all applicable\nfederal law.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21720","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"06fed32bc1f057e422908c8d35592541889e8f4f6055a3548a2878217319ea3c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.250","next":"us-ky/krs-39a.270"},"notice":"GroundRules: Original legal text.
