{"data":{"id":"us-ky/krs-39a.270","jurisdiction":"us-ky","citation":"KRS 39A.270","heading":"Use  of publicly owned  resources at impending, happening, or","body":"response  phase of disaster or emergency.\n(1) During the threatened or impending happening of a disaster or emergency, the\nGovernor, the Adjutant General, or the Director may authorize the use of public\nemployees, equipment, supplies, materials, funds, or any other publicly owned\nor supported resources to assist in the mitigation of the potential effects of the\ndisaster or emergency, regardless of whether the use is on public or private\nproperty.\n(2) During the actual happening of and any part of the response phase of a\ndisaster or emergency the Governor, the Adjutant General, or the Director,\nshall, when  necessary or desirable, authorize the use of public employees,\nequipment,  supplies, materials, funds, or any  other publicly owned  or\nsupported resource to assist in the operations of government, or the private\nsector, necessary to deal with the disaster or emergency, regardless of\nwhether the use is on public or private property.\n(3) During the actual happening or any part of the response phase of a disaster or\ndeclared emergency, the Governor or the General Assembly may, by executive\naction, legislation, or administrative regulation promulgated under KRS Chapter\n13A, declare which of the following services, if any, are essential:\n(a) Those  individuals and businesses that are necessary to deal with the\nresponse to the disaster or declared emergency or that protect the life\nand health of Kentucky citizens;\n(b) Individuals and businesses that are engaged in conduct, business, or an\nactivity that otherwise constitutes a critical infrastructure sector as\ndetermined by the United States Department of Homeland  Security's\nCybersecurity and Infrastructure Security Agency, or its successor; or\n(c) Individuals and businesses that are charged with responsibility for a\ngovernmental function related to a declared emergency or that is not in\nthe ordinary course of conduct or business, including responsibilities that\nrequire changes  to  the  medical, manufacturing, or  educational\nenvironment in which they typically operate.\n(4) After the active or response phase of the disaster or emergency has passed\nand the recovery phase has begun, the Governor, the Adjutant General, or the\nDirector may  authorize the use of public employees, equipment, supplies,\nfunds, or any other publicly owned  or supported resources to assist in the\nrecovery phase of the disaster or emergency, regardless of whether the use is\non public or private property.\n(5) A formal declaration of disaster or emergency shall not be necessary to invoke\nthe provisions of subsection (1) or (2) of this section.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50906","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"36554a3484efb9926d40407b3cacfda77f158de35e8a2a49b6fdf68fe5928518","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.260","next":"us-ky/krs-39a.275"},"notice":"GroundRules: Original legal text.
