{"data":{"id":"us-ky/krs-39a.300","jurisdiction":"us-ky","citation":"KRS 39A.300","heading":"Disaster Relief Funding Program.","body":"(1) The Disaster Relief Funding Program is established and shall be administered by\nthe Division of Emergency Management in accordance with the provisions of this\nsection.\n(2) A Disaster Relief Funding Program trust fund is established as a separate revolving\nfund. The trust fund shall be administered by the Division of Emergency\nManagement and the proceeds shall be used to support the Disaster Relief Funding\nProgram.\n(3) (a) 1. The Disaster Relief Funding Program trust fund may receive state\nappropriations, gi fts, grants, federal funds, and any other funds both\npublic and private.\n2. The Disaster Relief Funding Program trust fund shall not publicly\nadvertise for or solicit contributions from the general public that could\npotentially impact fundraising efforts o f not -for-profit disaster relief\nagencies.\n(b) Trust fund amounts not expended at the close of a fiscal year shall not lapse\nbut shall be carried forward to the next fiscal year.\n(c) Any interest earnings of the trust fund shall become a part of the trust fund\nand shall not lapse.\n(d) Any funds deposited in the trust fund are hereby appropriated for the purposes\nset forth in this section.\n(4) Eligibility for funds under the Disaster Relief Funding Program shall be limited to\ncities, counties, urban -counties, charter counties, and consolidated local\ngovernments of the Commonwealth and individuals who have disaster-related needs\nthat cannot or will not be met by other relief agencies and who are residents of, and\nliving in, the Commonwealth on the date of the emergency.\n(5) (a) Eligible applicants located in an area where there has been a declared\nemergency by the Governor, as defined in KRS 39A.020, may receive\nfinancial assistance when federal authorities decline to issue a federal\ndeclaration of disaster and federal assistance will not be forthcoming.\n(b) Cities, counties, urban -counties, charter counties, and consolidated local\ngovernments of the Commonwealth that are eligible applicants may receive\nfinancial assistance to pay the state contribution required  by the federal\ngovernment in cases where there has been a federal declaration of disaster.\n(6) The Division of Emergency Management shall promulgate administrative\nregulations necessary to carry out the provisions of this section.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21727","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"759e970e17993fdde708c90526eadf4a3d09bd23d528b358aecf5b8cb36e28a0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.295","next":"us-ky/krs-39a.303"},"notice":"GroundRules: Original legal text.
