{"data":{"id":"us-ky/krs-39a.350","jurisdiction":"us-ky","citation":"KRS 39A.350","heading":"Definitions for KRS 39A.350 to 39A.366.","body":"As used in KRS 39A.350 to 39A.366:\n(1) \"Disaster relief organization\" means an entity that provides emergency or disaster\nrelief services that include health services provided by volunteer health practitioners\nand that:\n(a) Is designated or recognized as a provider of those services pursuan t to a\ndisaster response and recovery plan adopted by an agency of the federal\ngovernment or the Kentucky Division of Emergency Management; or\n(b) Regularly plans and conducts its activities in coordination with an agency of\nthe federal government or the Kentucky Division of Emergency Management;\n(2) \"Emergency\" has the same meaning as used in KRS 39A.020;\n(3) \"Emergency declaration\" has the same meaning as \"declared emergency\" as used in\nKRS 39A.020;\n(4) \"Emergency Management Assistance Compact\" means the interstate compact\nestablished under KRS 39A.950;\n(5) \"Health facility\" has the same meaning as used in KRS 216B.015;\n(6) \"Health practitioner\" means an individual licensed under the laws of this or another\nstate to provide health services;\n(7) \"Health services\" means:\n(a) The provision of treatment, care, advice or guidance, other services, or\nsupplies related to the health or death of individuals or human populations, to\nthe extent necessary to respond to an emergency, including:\n1. The following, concerning the physical or mental condition or functional\nstatus of an individual or affecting the structure or function of the body:\na. Preventive, diagnostic, therapeutic, rehabilitative, maintenance, or\npalliative care; and\nb. Counseling, assessment, procedures, or other services;\n2. Sale or dispensing of a drug, a device, equipment, or another item to an\nindividual in accordance with a prescription; and\n3. Funeral, cremation, cemetery, or other mortuary services; or\n(b) The pro vision of treatment, care, advice or guidance, other services, or\nsupplies related to the health or death of an animal or to animal populations, to\nthe extent necessary to respond to an emergency, including:\n1. Diagnosis, treatment, or prevention of an animal disease, injury, or other\nphysical or mental condition by the prescription, administration, or\ndispensing of vaccine, medicine, surgery, or therapy;\n2. Use of a procedure for reproductive management; and\n3. Monitoring and treatment of animal population s for diseases that have\nspread or demonstrate the potential to spread to humans;\n(8) \"Host entity\" means an entity operating in this state which uses volunteer health\npractitioners to respond to an emergency;\n(9) \"License\" means authorization by a state t o engage in health services that are\nunlawful without the authorization. The term includes authorization under the laws\nof this state to an individual to provide health services based upon a national\ncertification issued by a public or private entity;\n(10) \"Scope of practice\" means the extent of the authorization to provide health services\ngranted to a health practitioner by a license issued to the practitioner in the state in\nwhich the principal part of the practitioner's services are rendered, including a ny\nconditions imposed by the licensing authority; and\n(11) \"Voluntary health practitioner\" means a health practitioner who provides health\nservices, whether or not the practitioner receives compensation for those services.\nThe term does not include a pract itioner who receives compensation pursuant to a\npreexisting employment relationship with a host entity or affiliate which requires\nthe practitioner to provide health services in this state, unless the practitioner is not\na resident of this state and is emp loyed by a disaster relief organization providing\nservices in this state while an emergency declaration is in effect.","path":["KRS Chapter 39A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21728","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"c612aed3542db3690cd4e2e6cbb97b47c094f14c2bdb821f4ebf7c2cfd63fa37","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39a.310","next":"us-ky/krs-39a.352"},"notice":"GroundRules: Original legal text.
