{"data":{"id":"us-ky/krs-39b.030","jurisdiction":"us-ky","citation":"KRS 39B.030","heading":"Powers, authorities, rights, and duties of local director -- Development of","body":"organizational structure.\nA local emergency management director, appointed pursuant to this chapter, shall have\nthe following powers, authorities, rights, and duties:\n(1) To represent the county judge/executive, or chief executive officers in the case of\ncounties acting jointly under KRS 39B.010, or mayor on all matters pertaining to\nthe comprehensive emergency management program and the disaster and\nemergency response of the c ounty, counties acting jointly under KRS 39B.010,\nurban-county, charter county, or the county or counties acting jointly and the cities\ntherein, unless there is a local director appointed for a city in accordance with this\nchapter, who represents that city;\n(2) To be the executive head and chief administrative officer of the local emergency\nmanagement agency, and to direct, control, supervise, and manage, the\ndevelopment, preparation, organization, administration, operation, implementation,\nand maintenance of the comprehensive emergency management program of the\ncounty, counties acting jointly under KRS 39B.010, urban -county government,\ncharter county government, or the county or counties acting jointly and the cities\ntherein, and to coordinate all local dis aster and emergency response, unless there is\na local director appointed for a city in accordance with this chapter, who represents\nthat city;\n(3) To develop and maintain a local emergency operations plan entitled \"county\nemergency operations plan,\" or \"joint counties emergency operations plan,\" or \"city\nemergency operations plan,\" or \"city/county emergency operations plan,\" as\nappropriate, the provisions of which shall establish the organizational structure to\nbe utilized by local government to manage disaster and emergency response, and set\nforth the policies, procedures, and guidelines for the coordination of all disaster and\nemergency response in the county and all the cities therein for an emergency,\ndeclared emergency, disaster, or catastrophe. The loc al emergency operations plan\nshall be developed consistent with the appropriate provisions of the Kentucky\nemergency operations plan, the provisions of KRS Chapters 39A to 39F, planning\nguidance issued by the division, and administrative regulations promul gated by the\ndivision. The local emergency operations plan shall be officially adopted by signed\nexecutive order of the county judge/executive or mayor, or in the case of counties\nacting jointly under KRS 39B.010, by all chief executive officers of the\nparticipating counties. The executive order shall be filed with the office of the clerk\nfor the local jurisdiction and a copy placed in the local emergency operations plan.\nA copy of the local emergency operations plan, and all revisions or updates thereto,\nshall be submitted by the local director to the Division of Emergency Management\nfor concurrence review and reference. The local emergency operations plan shall be\na component of the integrated emergency management system of the\nCommonwealth, and subject to  the Kentucky Emergency Operations Plan, shall be\nthe primary local strategic planning document governing the coordination of all\ndisaster and emergency response in the county, counties acting jointly under KRS\n39B.010, city, or the county or counties acti ng jointly and the cities therein, and\nshall be applicable to, utilized by, and adhered to by, all local emergency response\ndepartments, agencies, and officials of the local disaster and emergency services\norganization in the county and the cities therein.  The local emergency operations\nplan shall be updated not less than annually;\n(4) To establish and maintain a local disaster and emergency services organization in\naccordance with the local emergency operations plan, the Kentucky Emergency\nOperations Plan, and the provisions of KRS 39B.050;\n(5) To notify the county judge/executive, mayor, or executive authority of other local\ngovernments and the Division of Emergency Management immediately of the\noccurrence, or threatened or impending occurrence, of any eme rgency or disaster,\nand recommend any emergency actions which should be executed;\n(6) To be the chief advisor to, and the primary on -scene representative of, the county\njudge/executive, mayor, or executive authority of other local governments in the\nevent of occurrence of any emergency, declared emergency, disaster, or catastrophe\nwithin the local jurisdiction;\n(7) (a) To respond and have full access to the scenes of an emergency, declared\nemergency, disaster, or catastrophe to immediately investigate, anal yze, or\nassess the seriousness of all situations; to coordinate the establishment and\noperation of a local incident command or management system; to execute the\nlocal emergency operations plan, as appropriate; to activate the local\nemergency operations center or on-scene command post; to convene meetings,\ngather information, conduct briefings, and to notify the division of on -going\nresponse actions; and fully expedite and coordinate the disaster and\nemergency response of all local public and private agencie s, or to have a staff\nassistant do so;\n(b) At a declared emergency or declared disaster, at the direction of the county\njudge/executive or mayor, as appropriate, to take or direct immediate actions\nto protect public safety; however, this paragraph shall no t preclude a local\ndirector from providing any assistance that he is requested to, and is able to,\nprovide at any emergency.\n(8) To act as an official representative of the division in emergency situations when\nspecifically requested by the director;\n(9) To report directly to the county judge/executive, mayor, or executive authority of\nother local governments, act in an official policy-making capacity when carrying out\nthe duties of local emergency management director, and exercise full signatory\nauthority for execution of all contracts, agreements, or other official documents\npertaining to the administration and operation of the local emergency management\nagency and program;\n(10) To direct or supervise all paid or volunteer emergency management staff assist ants\nor other local emergency management agency workers, and all operating units or\npersonnel officially appointed and affiliated with the local disaster and emergency\nservices organization pursuant to KRS 39B.070;\n(11) To prepare and submit regular or scheduled program activity reports to the area\nmanager of the division and local chief executives;\n(12) To execute bond, if appropriate, in the amount determined by the appointing\nauthorities;\n(13) Annually, by the first day of March, to prepare and submit a program budget request\nto the county judge/executive and mayor;\n(14) Annually, by the fifteenth day of July, to prepare and submit to the division a\nlocally-approved, fiscal year program paper and budget request;\n(15) To perform all administrative, organizational, or operational tasks required by the\nprovisions of this chapter, or administrative regulations, or program guidance\npertaining thereto;\n(16) To be a registered member of the Kentucky Emergency Management Association or\nother professional emergency management organization; and\n(17) To carry out all other emergency management -related duties as required by KRS\nChapters 39A to 39F, administrative regulations, or local orders or ordinances.","path":["KRS Chapter 39B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43392","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"9526182cf4cdf17f6339392a8c64b38cae8e460cbdd87d6987097522bd27a295","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39b.020","next":"us-ky/krs-39b.040"},"notice":"GroundRules: Original legal text.
