{"data":{"id":"us-ky/krs-39b.070","jurisdiction":"us-ky","citation":"KRS 39B.070","heading":"Execution of emergency powers -- Emergency operations centers --","body":"Waiver of procedures and formalities.\nEach city, county, urban-county government, or charter county government may:\n(1) Through the county judge/executive of a county other than an urban -county\ngovernment, mayor of an urban -county government, chief executive of other local\ngovernments, or mayor of a city, or their designees as provided by ordinance,\ndeclare in writing a state of emergency when required, and thereafter execute any\nemergency powers granted under this chapter to provide for adequate and\nappropriate response to any occurrence or situation or any impending event or\nsituation resulting from any of the situations or events contemplated by KRS\n39A.010, 39A.020, or 39A.030;\n(2) Appropriate and expend funds, make contracts, enact cost -recovery ordinances,\nobtain and distribute equipment, materials, and supplies for disaster and emergency\nresponse purposes; provide for the health and safety of persons and property,\nincluding emergency assistance to the victims of any disaster or emergency; review\nor approve local emergency operations plans; and enact orders or ordinances\npertaining to local emergency management programs in accordance with the\npolicies and plans prescribed by the federa l and state emergency management\nagencies and the provisions of KRS Chapters 39A to 39F;\n(3) Appoint, employ, remove, or provide, with or without compensation, staff assistants\nto the local emergency management director, and clerical, administrative, techn ical\nor other local emergency management agency staff personnel, and local emergency\nmanagement agency-supervised operating units officially affiliated with the local\ndisaster and emergency services organization by city or county order or ordinance\nincluding rescue squads, auxiliary fire, police, and medical personnel, urban search\nand rescue teams, severe weather spotters teams, damage assessment teams,\namateur radio or communications personnel, or other emergency response groups,\nteams, or personnel, and other disaster and emergency response workers;\n(4) Establish a primary and one (1) or more secondary emergency operations centers or\non-scene command posts to serve as official local government command posts\nduring an emergency, declared emergency, disaster, or catastrophe;\n(5) Subject to the order of the Governor, or the chief executive of the county, urban -\ncounty government, charter county government, or city, to assign and make\navailable for duty, the employees, property, or equipment of the county or ci ty\nrelating to firefighting, engineering, rescue, health, medical and related services,\npolice, transportation, construction, and similar items or services for disaster and\nemergency response purposes within or outside of the physical limits of the county,\nurban-county government, charter county government, or city;\n(6) In the event of a national emergency or state of declared emergency or declared\ndisaster or catastrophe, as provided in KRS 39A.100, waive procedures and\nformalities otherwise required by th e law pertaining to: the performance of public\nwork; entering into contracts; the incurring of obligations; the employment of\npermanent and temporary workers; the utilization of volunteer workers; the rental of\nequipment; the purchase and distribution, wit h or without compensation, of\nsupplies, materials, and facilities; the appropriation and expenditure of public funds;\nand the demolition and removal of damaged public and private structures; and\n(7) Confer or authorize the conferring upon members of the au xiliary police the powers\nof peace officers, subject to the provisions of KRS 61.300, and any other\nrestrictions imposed by the appointing authority.","path":["KRS Chapter 39B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21745","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:58Z","sha256":"c51a423053f87ddc7d59721fc2ec81789101fd0c3ce276e66b01108e82ff80d1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39b.060","next":"us-ky/krs-39b.080"},"notice":"GroundRules: Original legal text.
