{"data":{"id":"us-ky/krs-39e.110","jurisdiction":"us-ky","citation":"KRS 39E.110","heading":"Committee duties.","body":"(1) Duties of the committees shall include:\n(a) Development of plans to prepare emergency response organizations within\ncities, counties, urban -county governments, and charter county governments\nto respond effectively to releases of hazardous substances;\n(b) Identification of a twenty -four (24) hour war ning point within the district to\nwhich persons responsible for releases of hazardous substances must report\nthose releases;\n(c) Establishment of a method, consistent with federal law, commission policies,\nand administrative regulations, by which manufactu rers, users, or storers of\nhazardous substances may report the presence of those substances, and by\nwhich members of the public may obtain information about those substances;\n(d) Appointment of a committee chairman, from among its members, for a term\nof two (2) years. Chairmen may be reappointed;\n(e) Development and maintenance of plans consistent with administrative\nregulations promulgated by the commission; and\n(f) Development of procedures for the annual review of emergency plans and\nprocedures developed under this chapter.\n(2) Local committees shall advise the commission of their actions by providing a copy\nof minutes to the commission within thirty (30) days of the date of the meeting. If\nthe minutes are later changed before approval, a copy of the revi sed minutes shall\nbe submitted to the commission within thirty (30) days of the approval.\n(3) Local committees may request the chief of the fire department with jurisdiction over\na facility which has, or may have, substances subject to Title III, Pub. L. N o. 99-\n499, to make on -site inspections of the facilities and to report all findings to the\nchairman of the committee.\n(4) Members of local committees shall serve for terms as specified by the commission,\nthough not to exceed four (4) years except by reappo intment. Committees may\nestablish attendance standards for continued membership and shall advise the\ncommission of any additions or deletions from the membership that are desired.\nThese changes may be approved or disapproved by the commission.\n(5) Committee meetings shall be subject to provisions of KRS 61.805 to 61.850\nrelating to public meetings and to KRS 61.870 to 61.884 relating to open records,\nprovided that trade secrets, as determined by the federal Environmental Protection\nAgency, are processed in accordance with 42 U.S.C. 11042.\n(6) The local committee may, after consultation with the commission chairman, seek\ncivil remedies prescribed in Section 326, Pub. L. No. 99-499.\n(7) The local committee may, with the advice and consent of the commission chairman,\nsubmit information to the county attorney for prosecution.\n(8) Consultations pursuant to subsection (6) of this section shall be made prior to the\ngiving of notice of intent to commence a civil action.","path":["KRS Chapter 39E"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21779","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:59Z","sha256":"d657a15618e6c0435c7b2b594081430e243a4476936209315752643b4d542ad7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39e.100","next":"us-ky/krs-39e.120"},"notice":"GroundRules: Original legal text.
