{"data":{"id":"us-ky/krs-39f.170","jurisdiction":"us-ky","citation":"KRS 39F.170","heading":"Workers' compensation coverage -- Limitations -- Enrollment.","body":"Rescue squad organizations or members of them or individuals associated with them for\nthe purposes of receiving workers' compensation benefits paid by the division shall be\ncovered by those benefits when performing emergency preparedness, response, or\nrecovery functions, with the following limitations:\n(1) Rescue squad organizations and individuals shall not be covered when performing\nfundraising functions, unless all proceeds of the function are to be dedicated to the\nadministration or operation of the rescue squad organization.\n(2) Rescue squad organizations and individuals shall not be covered when involved in\nany law enforcement activity, including security or evidence recovery, except for\ntraffic control at an accident scene or the recovery of evidence by diving or dragging\nwhen the assistance is requested by law enforcement authorities.\n(3) Rescue squad organizations and individuals shall not be covered when the primary\npurpose of the mission is the provision of emergency medical care or first aid.\nHowever, coverage shall be extended when:\n(a) A rescue squad provides emergency medical transportation when inclement\nweather or rough terrain prevents a regular ambulance from providing\ntransportation. Transportation may be provided only upon request of the\nappropriate emergency medical services agency. The distance of travel shall\nbe restricted to the nearest appropriate medical facility or ambulance;\n(b) Additional personnel or equipment are required to supplement existing\nemergency medical services which ha ve been overtaxed at an incident which\nis subsequently declared as an emergency by any official authorized to make\nsuch a determination; or\n(c) A rescue squad provides first aid, or emergency medical care is rendered as a\nnecessary function during a rescue  mission, and the primary purpose of the\nmission was the rescue and not the provision of emergency medical care.\n(4) Rescue squad organizations or individuals shall not be covered when engaging in\nfirefighting unless the firefighting was performed as a sec ondary function to protect\npersons involved in a rescue mission.\n(5) Rescue squad organizations or individuals shall not be covered when engaging in\nhazardous materials response, containment, cleanup, or other operations related to\nhazardous materials, whe n operating at the hazardous materials technician or\nhazardous materials specialist level of operation as defined in 29 C.F.R. 1910.120.\n(6) No person shall be covered unless enrolled on a workers' compensation enrollment\nform and filed with the area manag er of the division, except when the magnitude of\nan emergency, or a training exercise, is so great that a local emergency management\ndirector must solicit additional workers. At these times, the local director may\ndevelop and maintain a list of workers, to  include names, Social Security account\nnumbers, missions assigned, and dates covered and submit a copy of the list to the\narea manager of the division within twenty -four (24) hours of the conclusion of the\nemergency or the training exercise.","path":["KRS Chapter 39F"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21810","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:59Z","sha256":"e7be0d5cbb48ac6e18656dacd27183dbc3b8b3947bbf36d936469f7cff1b78a3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-39f.165","next":"us-ky/krs-39f.180"},"notice":"GroundRules: Original legal text.
