{"data":{"id":"us-ky/krs-40.080","jurisdiction":"us-ky","citation":"KRS 40.080","heading":"Supporting documents  -- Discretionary hearing.","body":"(1) All facts material to determining whether the claimant is entitled to receive a\nveterans' bonus shall be evidenced:\n(a) In any case where the same  are shown  in the official records of the\nDepartment  of Defense, Department of Veterans Affairs, or any other\ndepartment, bureau, or agency of the United States, by an authenticated\ncopy of the record, or a certificate made  by an authorized person in the\ndepartment, bureau, or agency concerned, or by a written communication\nsigned by such authorized person;\n(b) In any case where the same  are shown  in any public record of the\nCommonwealth  or of any public body in the Commonwealth, by a copy of\nthe  record, or the material part thereof, attested by the clerk or\ncomparable officer;\n(c) In any case where the same  are shown in an instrument of writing, by\ntendering the instrument, or a photostat copy, or a copy authenticated in a\nmanner  acceptable to the administrator;\n(d) Otherwise by affidavit.\n(2) No  claimant shall be entitled to an oral hearing as a matter of right; but the\nadministrator may  in his discretion order a hearing in any case presenting\nunusual circumstances, or where it appears that documentary evidence of any\nmaterial fact cannot reasonably be obtained, or where the claim cannot\notherwise adequately be determined. If a hearing is ordered, it shall be\nconducted  in accordance with KRS  Chapter 13B.
