{"data":{"id":"us-ky/krs-40.315","jurisdiction":"us-ky","citation":"KRS 40.315","heading":"State veterans' cemeteries -- Administrative regulations -- Funding.","body":"(1) The Department of Veterans' Affairs shall establish and maintain state veterans'\ncemeteries in the Commonwealth for the purpose of providing for the interment of\nveterans of the Armed Forces of the United States and for their eligible next of kin,\nas determined by the department.\n(2) Eligibility for interment at a Kentucky state veterans' cemetery shall include:\n(a) Persons who are eligible for interment in a veteran s' national cemetery\npursuant to 38 U.S.C. sec. 2402 and regulations promulgated thereunder; and\n(b) Any member of a reserve component of the Armed Forces, the Army National\nGuard, or the Air National Guard not otherwise qualified in paragraph (a) of\nthis subsection, if:\n1. The member completed the initial period of service as required by 10\nU.S.C. sec. 651(a) and was discharged under conditions other than\ndishonorable; or\n2. The member of the Army National Guard or the Air National Guard\ndied while on stat e active duty or while serving under Title 32 of the\nUnited States Code.\n(3) For a person eligible under subsection (2)(b) of this section, the eligibility for\ninterment of the person's spouse, surviving spouse, minor child, and dependent\nincapacitated child shall be determined pursuant to 38 U.S.C. sec. 2402(a)(5).\n(4) The Kentucky state veterans' cemeteries shall be under the administrative authority\nand control of the Department of Veterans' Affairs. The department may\npromulgate administrative regulatio ns necessary to operate the cemeteries in\ncompliance with applicable state and federal statutes and regulations.\n(5) The department shall provide interment service in accordance with 38 U.S.C. secs.\n2404 and 2408.\n(6) No person convicted of a state or federal criminal capital offense shall be eligible\nfor interment in a Kentucky state veterans' cemetery.\n(7) The departme nt is authorized to seek federal and private funding for the\nconstruction, renovation, and operation of Kentucky state veterans' cemeteries.","path":["KRS Chapter 40"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56650","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:00Z","sha256":"0d447adab13a84c56c89f0992d54636b7da7599558750d5d5e1f7fe9ae0c2e3d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-40.312","next":"us-ky/krs-40.317"},"notice":"GroundRules: Original legal text.
