{"data":{"id":"us-ky/krs-40.325","jurisdiction":"us-ky","citation":"KRS 40.325","heading":"Definition of \"nurse aide\" -- Veterans' nursing homes -- Office of Kentucky","body":"Veterans' Centers -- Administrative regulations -- Funding -- Contracts to hire\nlicensed nurses and nurse aides to provide long-term care.\n(1) As used in this sect ion, \"nurse aide\" means an individual who has successfully\ncompleted the nurse aide training and competency evaluation program and may\ninclude a nursing student, medication aide, or a person employed through a nursing\npool who provides nursing or nursing -related services to a resident in a nursing\nfacility, excluding:\n(a) An individual who is a licensed health professional;\n(b) A volunteer who provides the nursing or nursing -related services without\nmonetary compensation; or\n(c) A person who is hired by the  resident or family to sit with the resident and\nwho does not perform nursing or nursing-related services.\n(2) There shall be established and maintained in the Commonwealth of Kentucky state\nveterans' nursing homes to provide long -term care to veterans who  are residents of\nKentucky.\n(3) There is created the Office of Kentucky Veterans' Centers within the Office of the\nCommissioner of the Department of Veterans' Affairs. The office shall be headed by\nan executive director appointed pursuant to KRS 12.050. Th e office shall operate\nthe Kentucky state veterans' centers and medical division. The Department of\nVeterans' Affairs may promulgate any administrative regulations necessary to\noperate the homes in compliance with applicable state and federal statutes and\nregulations.\n(4) The Department of Veterans' Affairs may seek federal and private funding for the\nconstruction or renovation, and operation of Kentucky state veterans' nursing\nhomes.\n(5) The executive director of the Office of Kentucky Veterans' Centers, w ith the\napproval of the commissioner of the Department of Veterans' Affairs, may contract\nto hire licensed nurses and nurse aides in order to provide needed long -term care of\nveterans in residence at state veterans' nursing homes, and those contracts shall  not\nbe subject to KRS 45A.550 to 45A.554 or 45A.690 to 45A.725.","path":["KRS Chapter 40"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51206","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:00Z","sha256":"4ec4e84f24d9fd5b6cb626d3c651eda9a8a69f4574f3e48495ab2647e83fee21","source_id":"us-ky","stale":false,"prev":"us-ky/krs-40.320","next":"us-ky/krs-40.327"},"notice":"GroundRules: Original legal text.
