{"data":{"id":"us-ky/krs-40.345","jurisdiction":"us-ky","citation":"KRS 40.345","heading":"Private employer  may  have  voluntary veterans' preference","body":"employment  policy -- Registry of employers -- Administrative regulations.\n(1) The  following definitions apply in this section unless context otherwise\nrequires:\n(a) \"Private employer\" means  a sole proprietor, corporation, partnership,\nlimited liability company, or other entity with one (1) or more employees\nand  excludes the state, a municipality, county, school district, or public\ninstitution of higher education; and\n(b) \"Veterans' preference employment policy\" means  a private employer's\nvoluntary preference for hiring, promoting, or retaining a veteran over\nanother qualified applicant or employee.\n(2) A  private employer may  have a voluntary veterans' preference employment\npolicy. The veterans' preference employment policy shall be in writing and\napplied uniformly to employment  decisions regarding hiring, promotion, or\nretention during a reduction in workforce. The private employer may require the\nveteran to submit a Department of Defense form DD 214 as proof of eligibility\nfor the veterans' preference employment policy. Granting preference under this\nsection does not violate any local or state equal employment opportunity law,\nincluding but not limited to KRS Chapter 344.\n(3) The Department of Veterans' Affairs and the Education and Labor Cabinet may\nassist a private employer in determining the veteran's status as an applicant.\nThe Education and Labor Cabinet may maintain an online registry of employers\nthat have a voluntary veterans' preference employment policy as described in\nthis section and may  promulgate administrative regulations to assist in the\ncreation of this policy.","path":["KRS Chapter 40"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52327","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:00Z","sha256":"45d1584408b25b28613406210eef36f9601ea1a194daf7616e14a30a48b29c5f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-40.340","next":"us-ky/krs-40.350"},"notice":"GroundRules: Original legal text.
