{"data":{"id":"us-ky/krs-402.990","jurisdiction":"us-ky","citation":"KRS 402.990","heading":"Penalties.","body":"(1) Any party to a marriage prohibited by KRS 402.010 shall be guilty of a Class B\nmisdemeanor. If the parties continue after conviction to cohabit as man and wife,\neither or both of them shall be guilty of a Class A misdemeanor.\n(2) Any person who aids or abe ts the marriage of any person who has been adjudged\nmentally disabled, or attempts to marry, or aids or abets any attempted marriage\nwith any such person shall be guilty of a Class B misdemeanor.\n(3) Any authorized person who knowingly solemnizes a marriag e prohibited by this\nchapter shall be guilty of a Class A misdemeanor.\n(4) Any unauthorized person who solemnizes a marriage under pretense of having\nauthority, and any person who falsely personates the father, mother, or guardian of\nan applicant in obtaining a license shall be guilty of a Class D felony.\n(5) Any person who falsely and fraudulently represents or personates another, and in\nsuch assumed character marries that person, shall be guilty of a Class D felony.\nIndictment under this subsection shall be found only upon complaint of the injured\nparty and within two (2) years after the commission of the offense.\n(6) Any clerk who knowingly issues a marriage license to any persons prohibited by\nthis chapter from marrying shall be guilty of a Class A misde meanor and removed\nfrom office by the judgment of the court in which he is convicted.\n(7) Any clerk who knowingly issues a marriage license in violation of his duty under\nthis chapter shall be guilty of a Class A misdemeanor.\n(8) If any deputy clerk or any  person other than a county clerk knowingly issues a\nmarriage license in violation of this chapter, but not for a prohibited marriage, he\nshall be guilty of a Class A misdemeanor, and if he knowingly issues a license for a\nmarriage prohibited by this chapter, he shall be guilty of a Class A misdemeanor.\n(9) Any person who violates any of the provisions of KRS 402.090 shall be guilty of a\nviolation.\n(10) Any county clerk who violates any of the provisions of KRS 402.110 or 402.230\nshall be guilty of a violation.\n(11) Any person failing to make the return required of him by KRS 402.220 shall be\nguilty of a violation.","path":["KRS Chapter 402"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36498","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:29Z","sha256":"206e6b9910aded362c0c313b4e3a1bce31cac62c1f04fcbabac401e515ff81c0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-402.340","next":"us-ky/krs-403.010"},"notice":"GroundRules: Original legal text.
