{"data":{"id":"us-ky/krs-403.140","jurisdiction":"us-ky","citation":"KRS 403.140","heading":"Marriage -- Court may enter decree of dissolution or separation.","body":"(1) The Circuit Court shall enter a decree of dissolution of marriage if:\n(a) The court finds that one (1) of the parties, at the time the action was\ncommenced, resided in this state, or was stationed in this state while a\nmember of the armed services, and tha t the residence or military presence has\nbeen maintained for 180 days next preceding the filing of the petition;\n(b) The court finds that the conciliation provisions of KRS 403.170 either do not\napply or have been met;\n(c) The court finds that the marriage is irretrievably broken; and\n(d) To the extent it has jurisdiction to do so, the court has considered, approved or\nmade provision for child custody, the support of any child of the marriage\nentitled to support, the maintenance of either spouse, and the di sposition of\nproperty.\n(2) If a party requests a decree of legal separation rather than a decree of dissolution of\nmarriage, the court shall grant the decree in that form unless the other party objects,\nin which latter event the other provisions of this chapter shall apply.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1447","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:29Z","sha256":"fb38c2440a117c6e0cc756eade0bf46617becb5059414d85af62c1b6c2cf7bcc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.137","next":"us-ky/krs-403.150"},"notice":"GroundRules: Original legal text.
