{"data":{"id":"us-ky/krs-403.150","jurisdiction":"us-ky","citation":"KRS 403.150","heading":"Procedure -- Commencement of action, pleadings, abolition of existing","body":"defenses.\n(1) All proceedings under this chapter are commenced in the manner provided by the\nRules of Civil Procedure.\n(2) The verified petition in a proceeding for dissolution of m arriage or legal separation\nshall allege the marriage is irretrievably broken and shall set forth:\n(a) The age, occupation, Social Security number, and residence of each party,\nprovided in accordance with KRS 403.135, and his length of residence in this\nstate. If domestic violence and abuse, as defined in KRS 403.720, is alleged\nby either party, the party filing the petition shall certify the existence and\nstatus of any domestic violence protective orders. The party filing the petition\nand alleging the abus e may substitute the party's attorney's address as the\naddress of the party and any minor children;\n(b) The date of the marriage and the place at which it was registered;\n(c) That the parties are separated and the date on which the parties separated;\n(d) The names, ages, Social Security numbers, and addresses, provided in\naccordance with KRS 403.135, of any living infant children of the marriage,\nand whether the wife is pregnant;\n(e) Any arrangements as to custody, visitation, and support of the children and the\nmaintenance of a spouse; and\n(f) The relief sought.\n(3) Either or both parties to the marriage may initiate the proceeding.\n(4) If a proceeding is commenced by one (1) of the parties, the other party must be\nserved in the manner provided by the Rules  of Civil Procedure and may file a\nverified response.\n(5) Previously existing defenses to divorce and legal separation, including but not\nlimited to condonation, connivance, collusion, recrimination, insanity, and lapse of\ntime, are abolished.\n(6) The cour t may join additional parties proper for the exercise of its authority to\nimplement this chapter.\n(7) When the wife is pregnant at the time the petition is filed, the court may continue\nthe case until the pregnancy is terminated.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1448","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:29Z","sha256":"bc2dc70276cc2f4d3c1dde5c6397a0c3bc4eda7467adaceb3a6fa47c80a64684","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.140","next":"us-ky/krs-403.160"},"notice":"GroundRules: Original legal text.
