{"data":{"id":"us-ky/krs-403.160","jurisdiction":"us-ky","citation":"KRS 403.160","heading":"Temporary orders -- Maintenance, child support, injunction -- Disclosure","body":"of information on domestic violence or child abuse.\n(1) In a proceeding for dissolution of marriage or for legal separation, or in a\nproceeding for disposition of pr operty or for maintenance or support following\ndissolution of the marriage by a court which lacked personal jurisdiction over the\nabsent spouse, either party may move for temporary maintenance. The motion shall\nbe accompanied by an affidavit setting forth the factual basis for the motion and the\namounts requested.\n(2) (a) In a proceeding for dissolution of marriage, legal separation, or child support,\neither party, with notice to the opposing party, may move for temporary child\nsupport. The motion shall be accompanied by an affidavit setting forth the\nnumber of children of the marriage and the information required to calculate\nthe combined adjusted parental gross income set forth in KRS 403.212, and\nthe Social Security numbers, provided in accordance with KRS 403.135, of all\nparties subject to the motion. The court shall, within fourteen (14) days from\nthe filing of said motion, order an amount of temporary child support based\nupon the child support guidelines as provided by law, and the ordered child\nsupport shall be retroactive to the date of the filing of the motion unless\notherwise ordered by the court.\n(b) Upon a showing of good cause, either party may move the court to enter an\norder for temporary child support without written or oral notice to the adver se\nparty. After reviewing the affidavit required by paragraph (a) of this\nsubsection, the court may issue a temporary child support order based upon\nthe child support guidelines. The order shall provide that the order becomes\neffective seven (7) days follo wing service of the order and movant's affidavit\nupon the adverse party unless the adverse party, within the seven (7) day\nperiod, files a motion for a hearing before the court. The motion for hearing\nshall be accompanied by the affidavit required by parag raph (a) of this\nsubsection. Pending the hearing, the adverse party shall pay child support in\nan amount based upon the guidelines and the adverse party's affidavit. The\nchild support order entered following the hearing shall be retroactive to the\ndate of the filing of the motion for temporary support unless otherwise ordered\nby the court.\n(3) As part of a motion for temporary maintenance or support or by independent motion\naccompanied by affidavit, either party may request the court to issue a temporary\ninjunction or restraining order pursuant to the Rules of Civil Procedure.\n(4) If the court or agent of the court is made aware that there is reasonable evidence of\ndomestic violence or child abuse, the court shall determine whether disclosure to\nany other person of the information could be harmful to the parent or child, and if\nthe court determines that disclosure to any person could be harmful, the court and\nits agents shall not make the disclosure.\n(5) On the basis of the showing made and in conformity with  KRS 403.200, the court\nmay issue a temporary injunction or restraining order and an order for temporary\nmaintenance in amounts and on terms just and proper in the circumstances.\n(6) A temporary order or temporary injunction:\n(a) Does not prejudice the rig hts of the parties or the child which are to be\nadjudicated at subsequent hearings in the proceeding;\n(b) May be revoked or modified before final decree on a showing of the facts\nnecessary to revocation or modification under the circumstances; and\n(c) Terminates when the final decree is entered or when the petition for\ndissolution or legal separation is voluntarily dismissed.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52814","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:29Z","sha256":"9331c899b5ee199f20c1c780a8779b2c84b6cb2cc8c25095d9205abfad9327a7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.150","next":"us-ky/krs-403.170"},"notice":"GroundRules: Original legal text.
