{"data":{"id":"us-ky/krs-403.200","jurisdiction":"us-ky","citation":"KRS 403.200","heading":"Maintenance -- Court may grant order for either spouse.","body":"(1) In a proceeding for dissolution of marriage or legal separation, or a proceeding for\nmaintenance following dissolution of a marriage by a court which lacked personal\njurisdiction over the absent spouse, the court may grant a maintenance order for\neither spouse only if it finds that the spouse seeking maintenance:\n(a) Lacks sufficient property, including marital property apportioned to him, to\nprovide for his reasonable needs; and\n(b) Is unable to support himself through appropriate employment or is the\ncustodian of a child whose condition or circumstances make it appropriate that\nthe custodian not be required to seek employment outside the home.\n(2) The maintenance order shall be in such amounts and for such periods of time as the\ncourt deems just, and after considering all relevant factors including:\n(a) The financial resources of the party seeking maintenance, including marital\nproperty apportioned to him, and his ability to meet his needs independently,\nincluding the extent to which a provision for sup port of a child living with the\nparty includes a sum for that party as custodian;\n(b) The time necessary to acquire sufficient education or training to enable the\nparty seeking maintenance to find appropriate employment;\n(c) The standard of living established during the marriage;\n(d) The duration of the marriage;\n(e) The age, and the physical and emotional condition of the spouse seeking\nmaintenance; and\n(f) The ability of the spouse from whom maintenance is sought to meet his needs\nwhile meeting those of the spouse seeking maintenance.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1453","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:29Z","sha256":"48b61c4ba576b3a44e088aaf900d347046c8b57683dce471f4294c9aa779009b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.190","next":"us-ky/krs-403.210"},"notice":"GroundRules: Original legal text.
