{"data":{"id":"us-ky/krs-403.240","jurisdiction":"us-ky","citation":"KRS 403.240","heading":"Decree or temporary order -- Failure to comply with -- Good-cause defense","body":"-- Attorney's fees.\n(1) If a party fails to comply with a provision of a decree or temporary order or\ninjunction, the obligation of the other party to make payments for support or\nmaintenance or to permit visitation is not suspended; but he may move the court to\ngrant an appropriate order.\n(2) The failure of either party, without good cause, to comply with a provision of a\ndecree or temporary order or injunction, including a prov ision with respect to\nvisitation or child support shall constitute contempt of court, and the court shall\nremedy the failure to comply.\n(3) Good cause not to comply with a provision of a decree or temporary order or\ninjunction with respect to visitation sh all include mutual consent of the parties,\nreasonable belief by either party that there exists the possibility of endangerment to\nthe physical, mental, moral, or emotional health of the child, or endangerment to the\nphysical safety of either party, or extr aordinary circumstances as determined by the\ncourt.\n(4) The court may, if no reasonable cause is found for denial of visitation, award\nattorney's fees to the prevailing party.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1461","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:29Z","sha256":"c600f717079e4305eb7902ea662967a8760a0e02c94a2f45cfc16cc65f4b8a5c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.230","next":"us-ky/krs-403.250"},"notice":"GroundRules: Original legal text.
