{"data":{"id":"us-ky/krs-403.322","jurisdiction":"us-ky","citation":"KRS 403.322","heading":"Custody, visitation, and inheritance rights denied parent convicted of","body":"felony sexual offense from which victim delivered a child -- Waiver -- Child\nsupport obligation.\n(1) The Commonwealth recognizes that certain victims of sexual assault may  conceive\na child as a result of the sexual assault and may choose to bear and raise the child.\nThe Commonwealth also recognizes that victims of a sexual assault who have\nelected to raise a child born as a result of the sexual assault, as well as that chil d,\nmay suffer serious emotional or physical trauma if the perpetrator of the assault is\ngranted parental rights with the child.\n(2) Except as provided in subsection (3) of this section, any person who has been\nconvicted of a felony offense under KRS Chapte r 510, or a comparable offense\nfrom another jurisdiction, in which the victim of that offense has conceived and\ndelivered a child, shall not have custody or visitation rights, or the rights of\ninheritance under KRS Chapter 391 with respect to that child.\n(3) The adult mother of the child may waive the protection afforded under subsection\n(2) of this section regarding visitation and request that the court grant reasonable\nvisitation rights with the child if paternity has been acknowledged.\n(4) Unless waived by the mother, or a guardian of a minor mother or a de facto\ncustodian of the child in the case of a minor mother, and, if applicable, the public\nagency substantially contributing to the support of the child, a court shall establish a\nchild support obligation against the father of the child pursuant to KRS 403.211.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49999","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:29Z","sha256":"4d3fcd27c0977140a401af94d8ff0179fb0a98c4b08ea75f15349fce95505cb4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.320","next":"us-ky/krs-403.325"},"notice":"GroundRules: Original legal text.
