{"data":{"id":"us-ky/krs-403.648","jurisdiction":"us-ky","citation":"KRS 403.648","heading":"Proceedings pending before court -- Status report -- Emergency order.","body":"(1) Persons in a proceeding pending before a court may sign a collaborative law\nparticipation agreement to seek to resolve a collaborative matter related to the\nproceeding. The parties shall file promptly with the court a notice of the agreement\nafter it is signed. Subject to subsections (3) and (6) of this section, the filing\noperates as an application for a stay of the proceeding.\n(2) The parties shall file promptly with the court notice in a record when a collaborative\nlaw process concludes. The stay of the proceeding under subsection (1) of this\nsection is lifted when the notice is filed. The notice shall not specify any reason for\ntermination of the process.\n(3) A court in which a proceeding is stayed under subsection (1) of this section may\nrequire the parties and collaborative lawyers to provide a status report on the\ncollaborative law process and the proceeding. A status report may include only\ninformation on whether t he process is ongoing or concluded. It may not include a\nreport, assessment, evaluation, recommendation, finding, or other communication\nregarding a collaborative law process or collaborative law matter.\n(4) A court may not consider a communication made in  violation of subsection (3) of\nthis section.\n(5) A court shall provide parties notice and an opportunity to be heard before\ndismissing a proceeding in which a notice of collaborative process is filed based on\ndelay or failure to prosecute.\n(6) During a co llaborative law process, a court may issue emergency orders to protect\nthe health, safety, welfare, or interest of a party or an immediate family member\nthat resides in the party's home.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54891","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:30Z","sha256":"4a0fc1f328406a4d0b72facab38f9ae8034a4b520f469cc72a8435092da512f2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.646","next":"us-ky/krs-403.650"},"notice":"GroundRules: Original legal text.
