{"data":{"id":"us-ky/krs-403.650","jurisdiction":"us-ky","citation":"KRS 403.650","heading":"Disqualification of collaborative lawyer and lawyers in associated law firm.","body":"(1) Except as otherwise provided in subsection (3) of this section, a collaborative\nlawyer is disqualified from appearing before a court to represent a party in a\nproceeding related to the collaborative matter.\n(2) Except as otherwise provided in subsection (3) of this section and KRS 403.652 and\n403.654, a lawyer in a law firm with which the collaborative lawyer is associated is\ndisqualified from appearing before a c ourt to represent a party in a proceeding\nrelated to the collaborative matter if the collaborative lawyer is disqualified from\ndoing so under subsection (1) of this section.\n(3) A collaborative lawyer or a lawyer in a law firm with which the collaborative\nlawyer is associated may represent a party:\n(a) To ask a court to approve an agreement resulting from the collaborative law\nprocess; or\n(b) To seek or defend an emergency order to protect the health, safety, welfare, or\ninterest of a party, or an immediate  family member that resides in the party's\nhome if a successor lawyer is not immediately available to represent that\nperson.\n(4) If subsection (3)(b) of this section applies, a collaborative lawyer, or lawyer in a\nlaw firm with which the collaborative lawyer is associated, may represent a party or\nan immediate family member that resides in the party's home only until the person\nis represented by a successor lawyer or reasonable measures are taken to protect the\nhealth, safety, welfare, or interest of the person.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54892","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:30Z","sha256":"7ba514377dbfadca0766eb9b01eeb256144cbcf1996499e2c6212ac201432224","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.648","next":"us-ky/krs-403.652"},"notice":"GroundRules: Original legal text.
