{"data":{"id":"us-ky/krs-403.670","jurisdiction":"us-ky","citation":"KRS 403.670","heading":"Authority of court in case of noncompliance.","body":"(1) If an agreement fails to meet the requirements of KRS 403.644, or a lawyer fails to\ncomply with KRS 403.660 or 403.662, a court may nonetheless find that the parties\nintended to enter into a collaborative law participation agreement if they:\n(a) Signed a r ecord indicating an intention to enter into a collaborative law\nparticipation agreement; and\n(b) Reasonably believed they were participating in a collaborative law process.\n(2) If a court makes the findings specified in subsection (1) of this section, and the\ninterests of justice require, the court may:\n(a) Enforce an agreement evidenced by a record resulting from the process in\nwhich the parties participated;\n(b) Apply the disqualification provisions of KRS 403.650, 403.652, and 403.654;\nand\n(c) Apply a privilege under KRS 403.664.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54902","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:30Z","sha256":"4f3191ba98d4b2d9eea20c446c38cfab9b709aa4e7afb25fcc0f46b23873e912","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.668","next":"us-ky/krs-403.700"},"notice":"GroundRules: Original legal text.
