{"data":{"id":"us-ky/krs-403.705","jurisdiction":"us-ky","citation":"KRS 403.705","heading":"Domestic violence coordinating councils -- Membership  -- Purpose --","body":"Local  protocol required -- Domestic  violence fatality review teams  --\nDuties.\n(1) One  (1) or more  local domestic violence coordinating councils may  be\nestablished in any jurisdiction or group of counties.\n(2) Membership  on local domestic violence coordinating councils may include, but\nnot  be  limited to, judges, Commonwealth's  and  county attorneys, law\nenforcement officers, probation or parole officers, spouse abuse center staff,\nother victim advocates defined under KRS  421.570, family service workers\nemployed  by the Cabinet for Health and Family Services, mental health\nprofessionals, health care professionals, educators, public advocates, and\nother persons as deemed appropriate.\n(3) The purpose of local domestic violence coordinating councils shall include, but\nnot be limited to, the promotion of public awareness about domestic violence,\nthe facilitation of interagency coordination, and the assessment of service\ndelivery related to domestic violence.\n(4) Local domestic violence coordinating councils shall develop a local protocol\nconsistent with nationally recognized practice.\n(5) Local domestic violence coordinating councils may, if authorized by the local\ncoroner or a medical examiner, create a domestic violence fatality review team,\nthe purpose of which shall be to prevent future deaths and injuries related to\ndomestic violence.\n(6) Domestic violence fatality review teams of local domestic violence coordinating\ncouncils may:\n(a) Analyze information regarding local domestic violence fatalities to identify\ntrends, patterns, and risk factors;\n(b) Evaluate the effectiveness of local prevention and intervention strategies;\nand\n(c) Recommend,  to the appropriate state or local governmental agency,\nchanges  in the Kentucky Revised Statutes, administrative regulations,\npolicies, budgets, and treatment and service standards that may facilitate\nthe prevention of domestic violence fatalities. The fatality review team\nmay  establish a protocol for the investigation of domestic violence\nfatalities and may establish operating rules and procedures as it deems\nnecessary to carry out the purposes of this section.\n(7) The review of a case by a domestic violence fatality review team may include\ninformation from reports generated or received by agencies, organizations, or\nindividuals responsible for investigation, prosecution, or treatment in the case.\n(8) The proceedings, records, opinions, and deliberations of the domestic violence\nfatality review team shall be privileged and shall not be subject to discovery,\nsubpoena, or introduction into evidence in any civil action in any manner that\nwould directly or indirectly identify specific persons or cases reviewed by the\nlocal team. Nothing in this subsection shall be construed to restrict or limit the\nright to discover or use in any civil action any evidence that is discoverable\nindependent of the proceedings of the domestic violence fatality review team.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46339","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:30Z","sha256":"19c6520c96271b2910020e479571547fb7e87fee00497ab87eff34ae04e5c2d7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.700","next":"us-ky/krs-403.707"},"notice":"GroundRules: Original legal text.
