{"data":{"id":"us-ky/krs-403.707","jurisdiction":"us-ky","citation":"KRS 403.707","heading":"Sexual Assault Response Team Advisory Committee -- Co-chairs --","body":"Membership -- Duties.\n(1) The Sexual Assault Response Team Advisory Committee is established.\n(2) The Sexual Assault Response Team Advisory Committee shall be co-chaired by the\nchief executive officer of the Kentucky Association of Sexual Assault Programs or\nthe chief executive officer's designee and the commissioner of the Department of\nKentucky State Police or the commissioner's designee.\n(3) The membership of the Sexual Ass ault Response Team Advisory Committee shall\nconsist of the following:\n(a) The executive director of the Kentucky Board of Nursing or the executive\ndirector's designee;\n(b) The executive director of the Kentucky Nurses Association or the executive\ndirector's designee;\n(c) The executive director of the Kentucky Hospital Association or the executive\ndirector's designee;\n(d) The chief executive officer of the Children's Advocacy Centers of Kentucky\nor the chief executive officer's designee;\n(e) The director of the Department of Kentucky State Police Crime Lab or the\ndirector's designee;\n(f) The commissioner of the Department for Community Based Services or the\ncommissioner's designee;\n(g) The director of the Office of Victims Advocacy in the Office of the Attorn ey\nGeneral or the director's designee;\n(h) A sexual assault nurse examiner appointed by the secretary of the Cabinet for\nHealth and Family Services;\n(i) A representative from a sexual assault response team appointed by the chief\nexecutive officer of the Kentucky Association of Sexual Assault Programs;\n(j) A physician appointed by the secretary of the Cabinet for Health and Family\nServices; and\n(k) A Common wealth's attorney or an assistant Commonwealth's attorney\nappointed by the Attorney General.\n(4) Members appointed under subsection (3)(h) to (k) of this section shall serve at the\npleasure of the appointing authority and shall not serve longer than four ( 4) years\nwithout reappointment.\n(5) The Sexual Assault Response Team Advisory Committee shall:\n(a) Serve in an advisory capacity to the Kentucky Board of Nursing in\naccomplishing the duties set forth under KRS 314.142;\n(b) Serve in an advisory capacity to the Justice and Public Safety Cabinet in the\ndevelopment of the statewide sexual assault protocol required under KRS\n216B.400(5);\n(c) Develop a model protocol for the operation of sexual assault response teams\nwhich shall include the roles of sexual assaul t nurse examiners, physicians,\nlaw enforcement, prosecutors, and victim advocates;\n(d) Provide assistance to each regional rape crisis center, as designated by the\nCabinet for Health and Family Services, in establishing a regional sexual\nassault response team;\n(e) Develop model policies for law enforcement agencies related to handling\nsexual assault examination kits and investigating sexual assaults with a\nvictim-centered, evidence-based approach;\n(f) By July 1 of each year, report to the General Assembly a nd to the secretary of\nthe Justice and Public Safety Cabinet on the number of sexual assaults\nreported, the number of sexual assault examination kits submitted to the\nDepartment of Kentucky State Police forensic laboratory, the number of kits\ntested, and t he number of charges filed and convictions obtained in sexual\nassault cases in the previous calendar year;\n(g) Provide information and recommendations concerning the activities of the\nagency or organization represented by each individual committee member a s\nrelated to sexual assault issues and programs within the purview of the agency\nor organization; and\n(h) Recommend to the appropriate state agency any changes in statute,\nadministrative regulation, training, policy, and budget to promote a\nmultidisciplinary response to sexual assault.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57433","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:30Z","sha256":"7b8f76b3a7099e0b51e21f621caa320f4d77834bddc5654440f894d3258dc951","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.705","next":"us-ky/krs-403.710"},"notice":"GroundRules: Original legal text.
